SHORT TITLE.This Act may be cited as the ``Better Jobs through Evidence andInnovation Act''.SEC. 2. EVALUATIONS AND RESEARCH.(a) In General.--Section 169 of the Workforce Innovation andOpportunity Act (29 U.S.C. 3224) is amended--(1) by redesignating subsection (c) as subsection (d); and(2) by inserting after subsection (b) the following:``(c) Workforce Development Innovation Fund.--``(1) Program authorized.--``(A) In general.--The Secretary may, on acompetitive basis and in accordance with subparagraph(B), award workforce development innovation grantsdescribed in subparagraph (C) to eligible entities toenable such entities to--``(i) establish, implement, replicate, ortake to scale evidence-based, field-initiatedinnovation programs or services for improvingthe design and delivery of employment andtraining services--``(I) that generate demonstratedsustained improvements in earnings andemployment outcomes for participants(including participants who areindividuals with barriers toemployment); and``(II) that may demonstrateimprovements in--``(aa) the performance orimpact of the workforcedevelopment system with respectto the purposes of this Actdescribed in section 2 (29U.S.C. 3101), such asincreasing access to andopportunities for employment,education, training, andsupport services forindividuals with barriers toemployment;``(bb) addressing employerand labor market needs; or``(cc) the cost-effectiveness of suchinnovation programs orservices, particularly forparticipants and communitiesnot sufficiently served byexisting models such asparticipants and communities inrural areas; and``(ii) except with respect to an expansiongrant described in subparagraph (C)(iii) forwhich the Secretary waives an evaluationbecause the Secretary determines there aremultiple compelling examples of high-levelevidence, perform--``(I) a well-designed, well-implemented, and rigorous impactevaluation, through a partnership witha third-party research organization ora third-party researcher, of suchinnovation programs or services that--``(aa) assesses foreffectiveness in achieving anydemonstrated long-termimprovements in earnings andemployment outcomes forparticipants and forimprovements in other relevantoutcomes, such as the outcomesdescribed in item (aa), (bb),and (cc) of clause (i)(II); and``(bb) is accompanied by aprocess or implementationevaluation for the purpose ofprogrammatic improvement andsupporting scale-up; or``(II) in the case of an early-phase grant described in subparagraph(C)(i), an early-stage evaluation (suchas a feasibility study, pilot, orrapid-cycle evaluation) that preparesthe innovation program or service foran evaluation described in subclause(I) for a potential subsequent grant.``(B) Grant awards.--``(i) In general.--The Secretary--``(I) shall award grants undersubparagraph (A) on the primary basisof--``(aa) reliable evidencepresented with respect topotential achievements of theinnovation program or serviceproposed by the eligible entitywith respect to demonstrated,long-term improvements in anoutcome described in subclause(I) or (II) of subparagraph(A)(i);``(bb) the anticipated costof the program or servicerelative to anticipatedearnings and employmentoutcomes for participants;``(cc) the anticipatedcontribution of the evaluationof the program or service tothe overall evidence base,including evidence on cost-effectiveness; and``(dd) the existence ofsupporting projects ingeographically diverse sites,including rural areas, or thatserve populations with diverseneeds; and``(II) may award, undersubparagraph (A), different types ofgrants described under subparagraph (C)to an eligible entity for separateinnovation programs or services thatmeet the relevant criteria for suchdifferent types of grants.``(ii) Duration of award.--A grant awardedunder subparagraph (A) shall be awarded for aperiod determined appropriate by the Secretary.``(iii) Amount of award.--The Secretaryshall ensure that any grants awarded undersubparagraph (A) shall include sufficientfunding for the cost of the evaluation andprogram implementation.``(iv) Use of award.--An eligible entitythat receives a grant awarded undersubparagraph (A) shall use not less than 60percent of such award for direct programimplementation.``(C) Description of grants.--The grants describedin subparagraph (A) shall, to the extent feasible,include--``(i) early-phase grants for an innovationprogram or service supported by any level ofevidence described in clause (i), (ii), or(iii) of subparagraph (D), for the purposes offunding the development, implementation, andevaluation of such program or service;``(ii) mid-phase grants for an innovationprogram or service supported by a moderatelevel of evidence or a high level of evidence(as described in clause (ii) or (iii) ofsubparagraph (D), respectively) for thepurposes of funding the operation, refinement,expansion, and continued evaluation (asdescribed in subparagraph (A)(ii)(I)) of suchinnovation program or service at a single sitethat would, if successful, prepare the programor service for a subsequent expansion grant;and``(iii) expansion grants for an innovationprogram or service supported by a high level ofevidence, as described in subparagraph(D)(iii), for the purposes of--``(I) funding the operation of suchinnovation program or service at anexisting site;``(II) expansion or such innovationprogram or service to another site;``(III) implementation of a multi-site experimental rigorous impactevaluation of such innovation programor service; and``(IV) if necessary, continuedrefinement and adaption of the programor service model to address newcontexts or needs.``(D) Level of evidence standards.--The levels ofevidence described in this subparagraph are thefollowing:``(i) Low level of evidence.--An innovationprogram or service is supported by a low levelof evidence if such program or service hasdemonstrated, through a reasonable hypothesisand credible research findings (such as acorrelational study with statistical controlsfor selection bias), a descriptive study (suchas a case study), or evidence review and needsassessment, the--``(I) ability to achieve positiveeffects on earnings and employmentoutcomes for participants (includingparticipants who are individuals withbarriers to employment) and earningsfor employers; or``(II) potential to achieve sucheffect on such outcomes.``(ii) Moderate level of evidence.--Aninnovation program or service is supported by amoderate level of evidence if such program orservice has demonstrated the ability to achievesizable, but not yet conclusive, positiveeffects on earnings and employment outcomes forparticipants (including participants who areindividuals with barriers to employment) andearnings for employers, through--``(I) a well-designed and well-implemented experimental study of suchprogram or service, such as arandomized controlled trial; or``(II) a rigorous quasi-experimental study of such program orservice capable of drawing causalconclusions about the effectiveness ofsuch program or service.``(iii) High level of evidence.--Aninnovation program or service is supported by ahigh level of evidence if such program orservice has demonstrated, through replicationof studies, the ability to achieve asubstantial and statistically significant,positive impact on earnings and employmentoutcomes for participants (includingparticipants who are individuals with barriersto employment) and earnings for employers,through--``(I) 2 or more well-designed andwell-implemented experimental studiesof such program or service conducted atdifferent implementation sites; or``(II) through a well-designed andwell-implemented large, multi-site,experimental study.``(E) Funding allocation.--Of the funds madeavailable to carry out this subsection for a fiscalyear, the Secretary shall, except when determined thatthere is not a sufficient number of qualifyingapplications to do so, use--``(i) not less than 50 percent of suchfunds to award expansion grants described insubparagraph (C)(iii); and``(ii) not more than 25 percent of suchfunds to award early-phase grants described insubparagraph (C)(i).``(2) Technical assistance and evaluation research.--Of thefunds made available to carry out this subsection for a fiscalyear, the Secretary shall reserve not more than 10 percent ofthe funds to--``(A) provide technical assistance to eligibleentities, which may include preapplication workshops,web-based seminars, support for conducting feasibilitystudies and other planning activities, assistance withmethods and requirements for purposes of evaluationresearch under subparagraph (D), and support forimproving grant implementation and the quality andeffectiveness of activities and services funded bygrants awarded under paragraph (1)(A), including theuse of administrative data and information to improveoutcomes for participants;``(B) disseminate information on low-, moderate-,and high-evidence-based practices;``(C) fund staffing and other costs related to suchactivities; and``(D) conduct evaluation research regardingactivities or services funded by grants awarded undersubparagraph (A).``(3) Definitions.--In this subsection:``(A) Eligible entity.--The term `eligible entity'means an entity that is any of the following:``(i) A State workforce development boardestablished under section 101 (29 U.S.C. 3111).``(ii) A local workforce development boardestablished under section 107 (29 U.S.C. 3122).``(iii) An Indian tribe, tribalorganization, Alaska Native entity, Indian-controlled organization serving Indians, orNative Hawaiian organization that is eligibleto receive an award under section 166 (29U.S.C. 3221).``(iv) An institution of higher education(as defined in section 101 of the HigherEducation Act of 1965 (20 U.S.C. 1001)).``(v) A State workforce agency.``(vi) An organization--``(I) that--``(aa) is a community-basedorganization, a nonprofitorganization, or anongovernment organization,including a labor organization(as defined in section 2 of theNational Labor Relations Act(29 U.S.C. 152)); and``(bb) serves anunderserved population; or``(II) that is a national orregional organization that intends touse funds awarded under this Act tomake direct grants to an organizationdescribed in subclause (I).``(vii) A consortium of any entitiesdescribed in clause (i) through (vi).``(B) Field-initiated.--The term `field-initiated',with respect to a program or service, means a programor service in which the elements of the program orservice have been developed by practitioners orresearchers in the policy area, including such aprogram or service model that is--``(i) a sectoral employment program;``(ii) an employment social enterprise orother revenue-generating workforce programserving people overcoming barriers toemployment;``(iii) a registered apprenticeship;``(iv) a re-entry initiative;``(v) a career pathway model;``(vi) an industry and sector partnership;or``(vii) on-the-job or incumbent workertraining.``(C) Innovation program or service.--The term`innovation program or service' means a program orservice designed to demonstrate innovative and cost-effective ways to augment and improve employment,licensure, or training services.``(D) Well-designed and well-implementedexperimental study.--The term `well-designed and well-implemented experimental study' means a study that--``(i) is replicable;``(ii) uses programmatic and control groupsthat are representative of the type ofpopulation served by the program or servicethat is subject to the study, including byavoiding over-selection of participants who arehighly skilled prior to participation for suchprogrammatic group;``(iii) uses controls for aggregate shiftsthat might affect baseline numbers;``(iv) does not have problems withattrition of participants from the study;``(v) is conducted in a manner that isconsistent with applicable evaluation, data,and privacy standards and practices describedin the Foundations for Evidence-BasedPolicymaking Act of 2018 (Public Law 115-435;132 Stat. 5529) and the amendments made by thatAct; and``(vi) to the extent feasible, is alignedwith the standards for experimental studiesconducted pursuant to the education innovationand research program under section 4611 of theElementary and Secondary Education Act of 1965(20 U.S.C. 7261).``(4) Authorization of appropriations.--There areauthorized to be appropriated to carry out this subsection,such sums as may be necessary for each of the fiscal years 2027through 2031.''.(b) Conforming Amendment.--Section 132(a)(2)(A) of the WorkforceInnovation and Opportunity Act (29 U.S.C. 3172(a)(2)(A)) is amended bystriking ``169(c)'' and inserting ``169(d)''.<all>
