SHORT TITLE.This Act may be cited as the ``Stop Predator Dumping Act''.SEC. 2. DEFINITIONS.In this Act:(1) County governing district.--The term ``county governingdistrict'' means any ward, district, or geographic arearepresented by a member of the governing body of a county.(2) County subdivision.--The term ``county subdivision''means a subdivision of a county, as delineated by the Bureau ofthe Census for purposes of the most recent decennial census,including any minor civil division or census county division sodelineated, or, in the case of a county not so subdivided, thecounty itself.(3) Covered individual.--The term ``covered individual''means an individual who has been conditionally released to aresidence in the community, pursuant to the law of a coveredState, following civil commitment as a sexually violentpredator, sexually dangerous person, or comparable designationunder such law.(4) Covered state.--The term ``covered State'' means aState that has in effect a statute providing for the civilcommitment, and subsequent conditional release, of sexuallyviolent predators.SEC. 3. NATIONAL PLACEMENT FRAMEWORK.(a) In General.--Each covered State shall establish and enforce aplacement framework for covered individuals that satisfies thefollowing requirements:(1) Distance requirement.--A covered individual may not beplaced at a residence located within a 10-mile radius of theresidence of any other covered individual, at the same time;(2) Sequential placement.--A covered State may not place acovered individual in a county subdivision if there is anyother county subdivision within the same county that currentlycontains a fewer number of covered individuals; and(3) Large county cap.--In a county with a total populationexceeding 1,000,000, a covered State may not place a coveredindividual in a county subdivision or county governing districtif such placement would result in that subdivision or districtcontaining more than 25 percent of the total coveredindividuals placed within that county.SEC. 4. DEPARTMENT OF JUSTICE STUDY AND BEST PRACTICES.(a) Study.--Not later than 60 days after the date of enactment ofthis Act, the Attorney General shall initiate a comprehensive study onthe geographic placement of covered individuals within covered Statesupon their conditional release.(b) Matters Included.--The study conducted under subsection (a)shall examine--(1) the demographic and geographic distribution of placedcovered individuals;(2) the extent to which certain county subdivisions,particularly rural communities or specific regions such as theAntelope Valley in California, bear a disproportionate burdenof placements; and(3) the systemic factors that lead to the repeatedplacement or concentration of covered individuals in specificcounty subdivisions.(c) Best Practices and Promulgation.--Not later than 1 year afterthe date of enactment of this Act, the Attorney General shall--(1) compile best practices for the equitable geographicdistribution of covered individuals to prevent thedisproportionate concentration of such individuals in anysingle county subdivision; and(2) promulgate and distribute these best practices to therelevant State agencies of all States.SEC. 5. SVP BEST PRACTICES IMPLEMENTATION GRANT PROGRAM.(a) Authorization of Grants.--The Attorney General is authorized toaward grants to States to assist in the implementation andadministration of the best practices compiled and promulgated by theAttorney General under section 4(c).(b) Eligibility.--To be eligible to receive a grant under thissection, a State shall submit an application to the Attorney General atsuch time, in such manner, and containing such information as theAttorney General may require, including a certification that the Stateis actively adopting and integrating the equitable geographicdistribution best practices described in section 4(c).(c) Use of Funds.--A State receiving a grant under this sectionshall use the grant funds to implement, monitor, and enforce State-level policies that align with the best practices promulgated undersection 4(c), and for other related administrative or operational costsas determined appropriate by the State.(d) Authorization of Appropriations.--There are authorized to beappropriated to the Attorney General to carry out this section suchsums as may be necessary.<all>
