                                                                       Mrs. MILLER-MEEKS (for herself and Mr. SOTO) introduced the following bill;
                                                                             which was referred to the Committee on Energy and Commerce

                                                                      To require the Secretary of Commerce to conduct a study
                                                                         on the marketplace for advanced memory technology,
                                                                         and for other purposes.
                                                                        1  Be it enacted by the Senate and House of Representa-
                                                                        2 tives of the United States of America in Congress assembled,
                                                                        3     SECTION 1. SHORT TITLE.
                                                                        4  This Act may be cited as the ‘‘Memory Chip Competi-
                                                                        5 tiveness Assessment Act of 2026’’.
                                                                        6     SEC. 2. ADVANCED MEMORY TECHNOLOGY STUDY.
                                                                        7  (a) STUDY REQUIRED.—The Secretary shall conduct
                                                                        8 a study on the marketplace for advanced memory tech-

                                                                        1  (b) ELEMENTS.—In conducting the study required by
                                                                        2 subsection (a), the Secretary shall assess the following:
                                                                        3  (1) The marketplace for advanced memory tech-
                                                                        4  nology, including factors relating to the following:
                                                                        5  (A) Demand for advanced memory tech-
                                                                        6  nology.
                                                                        7  (B) Industries and products that use ad-
                                                                        8  vanced memory technology.
                                                                        9  (C) Supply constraints associated with ad-
                                                                      10  vanced memory technology.
                                                                      11  (2) The impact of trends in such advanced
                                                                      12  memory technology marketplace on the cost of end
                                                                      13  products for consumers and small businesses in the
                                                                      14  United States.
                                                                      15  (3) Capital intensity, investment cycles, and
                                                                      16  technology transition considerations for advanced
                                                                      17  memory technology.
                                                                      18  (4) The supply chain for advanced memory
                                                                      19  technology, including an analysis of suppliers of ad-
                                                                      20  vanced memory technology that are not domiciled in
                                                                      21  a country of concern.
                                                                      22  (5) Any legal, regulatory, or policy barrier re-
                                                                      23  lated to limitations in the supply of advanced mem-
                                                                      24  ory technology.

                                                                        1  (6) Any regulatory, legislative, or market solu-
                                                                        2  tion to increase supply in advanced memory tech-
                                                                        3  nology without obtaining a greater amount of such
                                                                        4  supply from a country of concern.
                                                                        5  (c) CONSULTATION.—In conducting the study re-
                                                                        6 quired by subsection (a), the Secretary shall consult with
                                                                        7 the following:
                                                                        8  (1) The head of any relevant Federal agency.
                                                                        9  (2) Non-governmental stakeholders, including
                                                                      10  the following:
                                                                      11  (A) Manufacturers of advanced memory
                                                                      12  technology.
                                                                      13  (B) Manufacturers of semiconductor man-
                                                                      14  ufacturing equipment and materials for ad-
                                                                      15  vanced memory technology.
                                                                      16  (C) Customers of advanced memory tech-
                                                                      17  nology, including internet service providers and
                                                                      18  manufacturers of consumer electronics and
                                                                      19  motor vehicles.
                                                                      20  (d) SUBMISSION; PUBLICATION.—Not later than 270
                                                                      21 days after the date of the enactment of this Act, the Sec-
                                                                      22 retary shall—
                                                                      23  (1) submit to the appropriate congressional
                                                                      24  committees a report on the study required by sub-

                                                                        1  (2) publish such report on a website of the De-
                                                                        2  partment of Commerce.
                                                                        3  (e) OPPORTUNITY FOR PUBLIC COMMENT.—Before
                                                                        4 the Secretary submits the report as required by subsection
                                                                        5 (d)(1), the Secretary shall provide an opportunity for pub-
                                                                        6 lic comment with respect to such report.
                                                                        7  (f) DEFINITIONS.—In this section:
                                                                        8  (1) ADVANCED  MEMORY  TECHNOLOGY.—The
                                                                        9  term ‘‘advanced memory technology’’ means semi-
                                                                      10  conductor memory products that—
                                                                      11  (A) are manufactured using leading-edge
                                                                      12  process technologies; and
                                                                      13  (B) are primarily designed for high-per-
                                                                      14  formance, high-bandwidth, or energy-efficient
                                                                      15  computing applications, including—
                                                                      16  (i) dynamic random-access memory at
                                                                      17  or below industry-leading nodes;
                                                                      18  (ii) high-bandwidth memory and 3-di-
                                                                      19  mensional-stacked memory architectures;
                                                                      20  (iii) 3-dimensional NAND that employ
                                                                      21  high-layer-count architectures that exceed
                                                                      22  200 layers; and
                                                                      23  (iv) memory solutions that enable sys-
                                                                      24  tems relating to artificial intelligence, data

                                                                        1  vanced communications, including DDR4,
                                                                        2  DDR5, LPDDR, and any other commer-
                                                                        3  cially significant memory technologies.
                                                                        4  (2) APPROPRIATE  CONGRESSIONAL  COMMIT-
                                                                        5  TEES.—The  term ‘‘appropriate congressional com-
                                                                        6  mittees’’ means—
                                                                        7  (A) the Committee on Energy and Com-
                                                                        8  merce of the House of Representatives; and
                                                                        9  (B) the Committee on Commerce, Science,
                                                                      10  and Transportation of the Senate.
                                                                      11  (3) COUNTRY OF CONCERN.—The term ‘‘coun-
                                                                      12  try of concern’’ has the same meaning given the
                                                                      13  term ‘‘covered nation’’ in section 4872(f) of title 10,
                                                                      14  United States Code.
                                                                      15  (4) SECRETARY.—The term ‘‘Secretary’’ means
                                                                      16  the Secretary of Commerce (acting through the Of-
                                                                      17  fice of the Secretary of Commerce).
