SHORT TITLE.4This Act may be cited as the ‘‘American Quantum5 Competitiveness Act’’.6 SEC. 2. DEFINITIONS.ssavage on LAPJG3WLY3PROD with BILLS7In this Act:VerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016321(1) AGENCY.—The term ‘‘agency’’ has the2meaning given that term in section 551 of title 5,3United States Code.4(2) COVERED NATION.—The term ‘‘covered na-5tion’’ has the meaning given that term in section64872(f) of title 10, United States Code.7(3) CRITICAL COMPONENT.—The term ‘‘critical8component’’ means any commodity, material, prod-9uct, hardware, software, or input in foreign or inter-10state commerce relating to quantum technology nec-11essary for—12(A) commercial manufacturing, establish-13ment, deployment, use, or scaling of quantum14technology; or15(B) the commercial leadership of the16United States in the commercial establishment17and deployment of quantum technology.18(4) QUANTUM INFORMATION SCIENCE.—The19term ‘‘quantum information science’’ means the use20of the law of quantum physics for the storage, trans-21mission, manipulation, computing, or measurement22of information.23(5) QUANTUM TECHNOLOGY.—The term ‘‘quan-24tum technology’’ means the application of quantumssavage on LAPJG3WLY3PROD with BILLS•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016331information science in interstate or foreign com-2merce.3(6) SECRETARY.—The term ‘‘Secretary’’ means4the Secretary of Commerce.5(7) TRUSTED FOREIGN PARTNER.—The term6‘‘trusted foreign partner’’ means—7(A) the European Union; or8(B) a foreign country that—9(i) is not a covered nation; and10(ii) is a member of—11(I) the North Atlantic Treaty Or-12ganization;13(II) the European Union; or14(III) the Organisation for Eco-15nomic Co-operation and Development.16(8) TRUSTED QUANTUM SUPPLY CHAIN.—The17term ‘‘trusted quantum supply chain’’, with respect18to quantum technology, means the sourcing of any19critical component from the United States or a20trusted supplier, whether in interstate or foreign21commerce.22(9) TRUSTED SUPPLIER.—The term ‘‘trusted23supplier’’ means an entity that—24(A) is domiciled in the United States or inssavage on LAPJG3WLY3PROD with BILLS25a trusted foreign partner;•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016341(B) is headquartered in the United States2or in a trusted foreign partner;3(C) has the principal place of business of4the entity in the United States or in a trusted5foreign partner; and6(D) is organized under the laws of the7United States or in a trusted foreign partner.8 SEC. 3. PROMOTING COMMERCIAL LEADERSHIP ON QUAN-9TUM TECHNOLOGY AND TRUSTED QUANTUM10SUPPLY CHAINS.11The Secretary shall carry out the following:12(1) Serve as the principal advisor to the Presi-13dent for policy related to the following:14(A) The commercial manufacturing, estab-15lishment, deployment, use, and scaling of quan-16tum technology.17(B) The supply of any critical component,18including with respect to the availability of any19such component.20(C) The establishment, maintenance, and21resiliency of any trusted quantum supply chain.22(2) Carry out any action as appropriate to sup-23port the commercial leadership of the United States24with respect to quantum technology and any criticalssavage on LAPJG3WLY3PROD with BILLS25component, including the following:•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016351(A) Supporting the commercial manufac-2turing, establishment, deployment, use, or scal-3ing of quantum technology.4(B) Promoting investment by private sec-5tor entities in the commercial manufacturing,6establishment, deployment, use, or scaling of7quantum technology in the United States.8(C) Entering into an agreement with any9of the following:10(i) A trusted supplier.11(ii) A trusted foreign partner.12(iii) An agency.13(iv) A State, or agency thereof.14(v) Any other entity as the Secretary15determines appropriate.16(3) In carrying out paragraphs (1) and (2),17consult with stakeholders as the Secretary deter-18mines appropriate, including with individuals and19private sector entities with expertise in the commer-20cial manufacturing, establishment, deployment, use,21or scaling of quantum technology.ssavage on LAPJG3WLY3PROD with BILLS•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016361 SEC. 4. ADDITIONAL REQUIREMENTS RELATING TO ESTAB-2LISHMENT, MAINTENANCE, AND RESILIENCY3OF ANY TRUSTED QUANTUM SUPPLY CHAIN.4(a) IN GENERAL.—In carrying out section 3(1)(C),5 the Secretary shall carry out the following:6(1) Use any authority of the Secretary or direct7any program of the Department of Commerce, as8the Secretary determines appropriate, to promote9the establishment, maintenance, and resiliency of a10trusted quantum supply chain.11(2) Identify barriers to investment in a trusted12quantum supply chain and take appropriate action13to address any such barrier.14(3) Establish a method and means for the Sec-15retary to—16(A) identify critical components and assess17the availability of such critical components, in-18cluding any critical component imported from19and manufactured in a covered nation or manu-20factured by a trusted supplier; and21(B) assess, manage, and reduce any risk22related to the acquisition of a critical compo-23nent provided or supplied by a covered nation.24(4) Assess, manage, and reduce any risk relatedssavage on LAPJG3WLY3PROD with BILLS25to the supply of a critical component provided by a26covered nation, in coordination with the following:•HR 10163 IHVerDate Sep 11 2014 20:59 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016371(A) Any relevant trusted foreign partner.2(B) Any relevant trusted supplier.3(C) Any relevant agency.4(b) NATIONAL STRATEGY.—5(1) IN GENERAL.—Not later than 2 years after6the date of the enactment of this Act, and every 37years thereafter, the Secretary shall establish and8publish on a publicly available website a report that9includes the following:10(A) A description of the following:11(i) Any action carried out by the Sec-12retary pursuant to subsection (a) and sec-13tion 3(2).14(ii) Any emerging risk or long-term15trend related to the economic competitive-16ness of the United States with respect to17the following:18(I) Quantum technology.19(II) Any critical component.20(III) Any trusted quantum sup-21ply chain.22(B) A comprehensive strategy to ad-23vance—ssavage on LAPJG3WLY3PROD with BILLS•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016381(i) the commercial leadership of the2United States in quantum technology and3any critical component; and4(ii) the establishment, maintenance,5and resiliency of a trusted quantum supply6chain.7(C) Any recommendation by the Secretary8for additional legislation (including an Act of9Congress), other action by the Federal Govern-10ment or any State government, or activity by11the private sector to strengthen the economic12competitiveness of the United States with re-13spect to quantum technology and a trusted14quantum supply chain.15(2) PUBLIC CONSULTATION.—In establishing16and publishing a report pursuant to paragraph (1),17the Secretary shall consult with stakeholders as the18Secretary determines appropriate, including with in-19dividuals and private sector entities with expertise in20the commercial manufacturing, establishment, de-21ployment, use, or scaling of quantum technology.22(c) RULE OF CONSTRUCTION.—Nothing in this sec-23 tion may be construed to require—24(1) a private sector entity to—ssavage on LAPJG3WLY3PROD with BILLS•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H10163.IH H1016391(A) share information with the Secretary;2or3(B) implement any measure or rec-4ommendation established by the Secretary; or5(2) the Secretary to disclose confidential busi-6ness information or trade secrets.Æssavage on LAPJG3WLY3PROD with BILLS•HR 10163 IHVerDate Sep 11 2014 20:10 Aug 28, 2026 Jkt 069200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6301 E:\BILLS\H10163.IH H10163
