                                AN ACT
1 Amending Title 63 (Professions and Occupations (State Licensed))
2    of the Pennsylvania Consolidated Statutes, in powers and
3    duties, further providing for definitions and providing for
4    artificial intelligence.
5    The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7    Section 1.    Section 3102 of Title 63 of the Pennsylvania
8 Consolidated Statutes is amended by adding definitions to read:
9 § 3102.   Definitions.
10    The following words and phrases when used in this chapter
11 shall have the meanings given to them in this section unless the
12 context clearly indicates otherwise:
13    "Artificial intelligence."    A machine-based system that can,
14 for a given set of human-defined objectives, make predictions,
15 recommendations or decisions influencing real or virtual
16 environments, including the ability to perceive real and virtual
17 environments, to abstract the perceptions into models through
18 automated analysis and to use model inference to formulate
19 options for information or action. The term includes generative
1 artificial intelligence.

3    "Generative artificial intelligence."     The class of models
4 that emulate the structure and characteristics of input data in
5 order to generate derived synthetic content, including
6 information such as images, videos, audio clips or text, that
7 has been significantly modified or generated by algorithms,
8 including by artificial intelligence.

10    Section 2.      Title 63 is amended by adding a section to read:
11 § 3107.2.      Artificial intelligence.
12    (a)   Rules.--Each licensing board and licensing commission
13 shall establish rules addressing the use of artificial
14 intelligence by licensees when providing services within the
15 licensee's authorized scope of practice under the applicable
16 practice act. The rules shall be consistent with the applicable
17 practice act.
18    (b)   Contents.--Rules shall address, at a minimum, all of the
19 following:
20(1)    The conditions under which a licensee may use
21    artificial intelligence in providing services within the
22    licensee's authorized scope of practice under the applicable
23    practice act.
24(2)    The level of review, supervision or approval
25    required of a licensee before information, work product,
26    recommendations or other output generated by artificial
27    intelligence may be used or relied upon in providing
28    services.
29(3)    Disclosure by a licensee to the person receiving
30    services regarding the use of artificial intelligence,

1    including the manner, content and timing of a plain-language
2    disclosure, when the person is receiving information, work
3    product or services generated in whole or in substantial part
4    by artificial intelligence.
5(4)   A requirement that each person receiving services
6    shall be provided with the option to communicate directly
7    with a licensee, rather than solely through artificial
8    intelligence, and the process for exercising that option.
9(5)   The duties and obligations of a licensee when using
10    artificial intelligence, including the responsibility of a
11    licensee to exercise professional judgment and comply with
12    all ethical, confidentiality, recordkeeping and other
13    obligations imposed on the licensee under the applicable
14    practice act, notwithstanding the use of artificial
15    intelligence in providing services.
16(6)   Limitations on the use of artificial intelligence,
17    including that artificial intelligence may not independently
18    perform professional services, make professional decisions,
19    establish a professional relationship or fulfill a duty
20    imposed on a licensee under the applicable practice act.
21(7)   The circumstances under which the use of artificial
22    intelligence may constitute unprofessional conduct, a
23    violation of the applicable practice act or grounds for
24    discipline.
25    (c)   Construction.--Nothing in this section shall be
26 construed to:
27(1)   limit the authority of a licensing board or
28    licensing commission to regulate the use of artificial
29    intelligence by licensees under a practice act; or
30(2)   require disclosure of the use of artificial

1    intelligence for a purely administrative, clerical or
2    ministerial function that does not involve individualized
3    professional advice, recommendations, evaluations, treatment,
4    analysis or decisions.
5    (d)     Regulations.--A licensing board or licensing commission
6 may promulgate regulations as necessary to implement this
7 section.
8    Section 3.    This act shall take effect in 60 days.
