                                 AN ACT
1 Amending Title 74 (Transportation) of the Pennsylvania
2    Consolidated Statutes, in turnpike, further providing for
3    electronic toll collection.
4    The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6    Section 1.      Section 8117(b) of Title 74 of the Pennsylvania
7 Consolidated Statutes is amended by adding a paragraph to read:
8 § 8117.    Electronic toll collection.

10    (b)    Imposition of liability.--Liability under this section
11 shall be imposed upon an owner for failure to pay the prescribed
12 toll charges assessed under this section or the regulations of
13 the commission occurring within the territorial limits of this
14 Commonwealth. Based on evidence obtained by a toll collection
15 system, the following shall apply:

17(1.3)   The following limitations on text-based
18    communications by the commission apply:
1(i)    The commission, including an authorized agent,
2      contracted third party or employee of the commission, may
3      not send a text-based communication to the mobile phone
4      of an owner notifying the owner of:
5(A)   unpaid toll charges or fees that the owner
6is liable for under this section;
7(B)   a link to an Internet website of the
8commission, including an authorized agent or
9contracted third party of the commission, through
10which the owner can electronically pay unpaid tolls
11or fees the owner is liable for under this section;
12(C)   collection action that may or will be taken
13by the commission if the owner does not pay the
14unpaid tolls or fees the owner is liable for under
15this section; and
16(D)   any other enforcement actions authorized by
17the laws of this Commonwealth that the commission may
18or will take if the owner does not pay the unpaid
19tolls or fees the owner is liable for under this
20section, including the suspension of the owner's
21registration under 75 Pa.C.S. § 1380 (relating to
22suspension of registration upon unpaid tolls).
23(ii)    Subparagraph (i) shall not apply to text-based
24      communications sent to a mobile phone by:
25(A)   a collection agency contracted with the
26commission to an owner whose unpaid tolls and fees
27have been turned over to the collection agency to
28resolve payment of liability owed by the owner under
29this section;
30(B)   the commission to an owner who has

1established an account with the commission for
2electronic toll collection and has affirmatively
3consented to receiving text-based communications; and
4(C)   the commission through a commission-approved
5mobile phone application installed on the mobile
6phone.

8   Section 2.    This act shall take effect in 60 days.
