hb2583/introduced.txtPRINTER'S NO. 3472THE GENERAL ASSEMBLY OF PENNSYLVANIAHOUSE BILLNo. 2583Session of2026INTRODUCED BY KOSIEROWSKI, ISAACSON, FREEMAN, RIVERA, HILL-EVANS, STEELE, BOROWSKI, SANCHEZ, CURRY, SHUSTERMAN, MERSKI,DELLOSO, GUZMAN, OTTEN, MADDEN, KAZEEM, MAYES AND FRITZ,JUNE 1, 2026REFERRED TO COMMITTEE ON HUMAN SERVICES, JUNE 1, 2026AN ACT1 Amending the act of April 9, 1929 (P.L.343, No.176), entitled2 "An act relating to the finances of the State government;3 providing for cancer control, prevention and research, for4 ambulatory surgical center data collection, for the Joint5 Underwriting Association, for entertainment business6 financial management firms, for private dam financial7 assurance and for reinstatement of item vetoes; providing for8 the settlement, assessment, collection, and lien of taxes,9 bonus, and all other accounts due the Commonwealth, the10 collection and recovery of fees and other money or property11 due or belonging to the Commonwealth, or any agency thereof,12 including escheated property and the proceeds of its sale,13 the custody and disbursement or other disposition of funds14 and securities belonging to or in the possession of the15 Commonwealth, and the settlement of claims against the16 Commonwealth, the resettlement of accounts and appeals to the17 courts, refunds of moneys erroneously paid to the18 Commonwealth, auditing the accounts of the Commonwealth and19 all agencies thereof, of all public officers collecting20 moneys payable to the Commonwealth, or any agency thereof,21 and all receipts of appropriations from the Commonwealth,22 authorizing the Commonwealth to issue tax anticipation notes23 to defray current expenses, implementing the provisions of24 section 7(a) of Article VIII of the Constitution of25 Pennsylvania authorizing and restricting the incurring of26 certain debt and imposing penalties; affecting every27 department, board, commission, and officer of the State28 government, every political subdivision of the State, and29 certain officers of such subdivisions, every person,30 association, and corporation required to pay, assess, or31 collect taxes, or to make returns or reports under the laws32 imposing taxes for State purposes, or to pay license fees or1 other moneys to the Commonwealth, or any agency thereof,2 every State depository and every debtor or creditor of the3 Commonwealth," in human services, providing for medical4 assistance payments for medical equipment and supplies.5 The General Assembly of the Commonwealth of Pennsylvania6 hereby enacts as follows:7 Section 1. The act of April 9, 1929 (P.L.343, No.176), known8 as The Fiscal Code, is amended by adding a section to read:9 Section 1607-T. Medical assistance payments for medical10equipment and supplies.11 (a) Payment.--To the extent money is appropriated for this12 purpose, the Department of Human Services shall make a one-time13 payment to a medical assistance managed care organization for14 the purpose of increasing payments to participating medical15 assistance providers for medical equipment and supplies. The16 Department of Human Services shall make the payment no later17 than December 31, 2027.18 (b) Amount.--The amount of a payment under subsection (a)19 shall be determined by multiplying the amount paid during20 calendar year 2024 by the medical assistance managed care21 organization to participating medical assistance providers for22 medical equipment and supplies by 10%.23 (c) Managed care organization payment.--No later than 3024 days after receiving a payment under subsection (a), a medical25 assistance managed care organization shall make a payment to26 each participating medical assistance provider for medical27 equipment and supplies.28 (d) Amount of participating medical assistance provider29 payment.--The amount of a payment under subsection (c) to a30 participating medical assistance provider shall be determined by31 multiplying the amount paid during calendar year 2024 by the32 medical assistance managed care organization to the20260HB2583PN3472 - 2 -1 participating medical assistance provider for medical equipment2 and supplies by 10%.3 (e) Definitions.--As used in this section, the following4 words and phrases shall have the meanings given to them in this5 subsection unless the context clearly indicates otherwise:6 "Medical assistance provider." A person or entity enrolled7 by the Department of Human Services as a provider of services in8 the medical assistance program.9 "Medical equipment and supplies." An item specified by10 Federal or State law or regulation as compensable under the11 medical assistance program.12 "Participating medical assistance provider." A medical13 assistance provider that participates in the provider network of14 a medical assistance managed care organization.15 Section 2.
