Title 75 of the Pennsylvania Consolidated8 Statutes is amended by adding a section to read:9 § 3118. Automated road safety monitoring systems.10 (a) Authorization.--11(1) A municipality, after passage of an ordinance, is12 authorized to use an automated road safety monitoring system13 approved by the department to prosecute enforceable14 violations in a school zone.15(2) A municipality that uses an automated road safety16 monitoring system under paragraph (1) may enter into a17 contract with an entity, including the manufacturer or vendor18 of automated road safety monitoring systems or other person19 to implement, administer, operate or otherwise conduct the1 issuance, processing and the collection of citations and2 fines.3 (b) Owner liability.--Except as provided under subsection4 (e), the registered owner of the motor vehicle shall be liable5 for the penalty imposed under this section.6 (c) Notification of violation and penalty.--7(1) A fine under this section shall be $40.8(2) For the first 30 days after an automated road safety9 monitoring system becomes operational in a municipality, the10 municipality may send a written warning to the registered11 owner of a motor vehicle for the purposes of education in12 lieu of enforcement through a fine.13(3) An enforceable violation issued by a municipality14 may not be:15(i) Made part of the operating record of the16individual upon whom the liability is imposed.17(ii) A conviction of a moving violation under18Subchapter B of Chapter 33 (relating to right-of-way) and19Subchapter C of Chapter 35 (relating to rights and duties20of pedestrians).21(4) The following apply to the notification of an22 enforceable violation:23(i) Notification from a municipality that authorizes24the use of an automated road safety monitoring system25shall include a notice of an enforceable violation to the26registered owner of a motor vehicle that is identified in27photographs or videos produced by an automated road28safety monitoring system as evidence of an enforceable29violation.30(ii) A rebuttable presumption exists that the20260HB2556PN3466 - 2 -1 registered owner of a motor vehicle was the driver of the2 motor vehicle when the citation for an enforceable3 violation was issued and notice delivered as provided in4 this section.5(iii) The notice of violation required under6 subparagraph (i) shall include:7(A) A copy of the photographs or video produced8by the automated road safety monitoring system and9any other data showing the motor vehicle in the10process of an enforceable violation.11(B) The registration number and state of12issuance of the motor vehicle.13(C) The name and address of the registered owner14of the motor vehicle.15(D) The date, time and location of the alleged16enforceable violation.17(E) The specific enforceable violation charged.18(F) Instructions for payment of the fine19imposed.20(G) A signed statement by a police officer or21trained technician employed by the municipality that,22based on the inspection of the recorded image, the23motor vehicle was being operated during the24commission of an enforceable violation.25(H) Instructions on how to appeal the citation26and to obtain a hearing.27(I) An affidavit form approved by the police28officer or trained technician employed by the29municipality for the purposes of making an appeal.30(iv) In the case of an enforceable violation20260HB2556PN3466 - 3 -1 involving a motor vehicle registered in this2 Commonwealth, the notice shall be mailed within 30 days3 of the enforceable violation to the address of the4 registered owner of the motor vehicle.5(v) If a motor vehicle is registered under the laws6 of another state or country, the notice shall be mailed7 within 45 days after obtaining the name and address of8 the registered owner of the motor vehicle. If the address9 is unavailable, it shall be sufficient to mail the notice10 to the official in the state or country that has charge11 of the registration of the motor vehicle.12(vi) If the registered owner of a motor vehicle13 involved in a violation is engaged in the business of14 leasing or renting motor vehicles, the registered owner15 remains liable for payment of any fine imposed under this16 section even if the registered owner was not driving the17 motor vehicle, but may obtain payment from the lessor or18 renter of the motor vehicle driving the motor vehicle at19 the time the enforceable violation occurred and forward20 the payment to the state or municipality imposing the21 civil penalty.22(vii) The notice shall be sent by first class mail.23 A manual or automatic record of mailing processed by or24 on behalf of the municipal agent in the ordinary course25 of business shall be prima facie evidence and shall be26 admitted as evidence in any judicial or administrative27 proceeding as to the facts.28(viii) A registered owner of a motor vehicle29 involved in a violation may appeal the violation as to30 matters of law and fact to the court of common pleas in20260HB2556PN3466 - 4 -1the county where the alleged violation occurred. The2appeal shall be made not later than 30 days after the3date on which the notice of violation was mailed. The4registered owner of the motor vehicle may assert in an5appeal that a notice served by first class mail or other6mail delivery service was not actually delivered. The7appeal shall be a de novo hearing.8 (d) Certificate as evidence.--A certificate, or a facsimile9 of a certificate, based upon inspection of recorded images10 produced by an automated road safety monitoring system and sworn11 to or affirmed by a police officer or trained technician12 employed by the municipality shall be prima facie evidence of13 the facts contained in it. The municipality must include a14 written statement that the automated road safety monitoring15 system was operating correctly at the time of the alleged16 violation. A recorded image evidencing an enforceable violation17 shall be admissible in any judicial or administrative proceeding18 to adjudicate the liability for the violation.19 (e) Exemptions.--A registered owner of a motor vehicle shall20 not be liable for a violation under this section if the21 enforceable violation was:22(1) necessary to allow the passage of an emergency23 vehicle;24(2) incurred while participating in a funeral25 procession;26(3) incurred during a period of time in which the motor27 vehicle was reported to the police department of any state,28 city or town as having been stolen and had not been recovered29 before the time the enforceable violation occurred; or30(4) necessary to comply with any other law or regulation20260HB2556PN3466 - 5 -1 governing the operation of a motor vehicle.2 (f) Signage and community notice.--3(1) A municipality that authorizes the use of an4 automated road safety monitoring system shall install at each5 location of an automated road safety monitoring system an6 unobstructed sign notifying the public that an automated road7 safety monitoring system is in use.8(2) A municipality that authorizes the use of an9 automated road safety monitoring system shall make a public10 announcement and conduct a public awareness campaign of its11 use of automated road safety monitoring systems beginning not12 less than 30 days before the first automated road safety13 monitoring system is put into use.14(3) A municipality may install but not activate15 automated road safety monitoring systems during the 30-day16 time period under paragraph (2).17 (g) Reporting.--18(1) Annually, not later than December 1, a municipality19 that authorizes the use of an automated road safety20 monitoring system shall transmit a report to the department21 that details each automated road safety monitoring system22 located in the municipality. The report shall include:23(i) A list of the locations of each automated road24safety monitoring system in the municipality.25(ii) An analysis of the nexus between public safety26and each location's automated road safety monitoring27system.28(iii) The number of fines and warnings issued for29enforceable violations under subsection (c).30(iv) The total amount of fines collected during the20260HB2556PN3466 - 6 -1year.2(v) Crash data, to the extent available, at each3separate location of an automated road safety monitoring4system.5(vi) The total number of pedestrians and other road6users present in the photographs or other recorded7evidence for all camera-enforceable violations for which8fines and warnings were issued during the one-year9period.10(2) The department shall post all reports received on11 the department's publicly accessible Internet website.12 (h) Compensation to manufacturer or vendor.--Compensation13 paid to a manufacturer or vendor of an automated road safety14 monitoring system shall be based on the value of the equipment15 and services provided or rendered in support of the automated16 road safety monitoring system and may not be based on the number17 of enforceable violations issued or a portion or percentage of18 the fine generated by the citations.19 (i) Photographs taken.--20(1) Photographs and other recorded evidence taken by an21 automated road safety monitoring system shall:22(i) Be destroyed not more than 48 hours after the23final disposition of an enforceable violation.24(ii) Not be discoverable in any judicial or25administrative proceeding, other than a proceeding held26pursuant to this section, without a court order. A27photograph or other recorded evidence taken pursuant to28this section shall not be admissible in any judicial or29administrative proceeding, other than in a proceeding to30adjudicate liability for a violation under this section,20260HB2556PN3466 - 7 -1 without a court order.2(iii) Only record enforceable violations and may not3 be used for any other surveillance purposes. The4 restrictions under this subparagraph may not preclude a5 court of competent jurisdiction from issuing an order6 directing that the information be provided to law7 enforcement officials if the information is reasonably8 described and is requested solely in connection with a9 criminal law enforcement action.10(iv) Not be utilized to take a frontal view11 photograph of a motor vehicle committing an enforceable12 violation. A frontal view photograph of a motor vehicle13 committing an enforceable violation taken by an automated14 road safety monitoring system shall not be discoverable15 or admissible in any judicial or administrative16 proceeding and shall not be used as the basis for an17 enforceable violation under this section. To the extent18 practicable, additional efforts shall be made to ensure19 that photographs produced by an automated road safety20 monitoring system do not identify the motor vehicle21 operator, the passengers or the contents of the motor22 vehicle. A notice of violation issued may not be23 dismissed solely because a photograph or photographs24 allowed for the identification of the motor vehicle25 operator, the passengers or the contents of the motor26 vehicle, if the municipality has made a reasonable effort27 to comply with this subparagraph.28(v) Blur any facial image of a pedestrian or other29 road user captured by the automated road safety30 monitoring system prior to uploading or otherwise sending20260HB2556PN3466 - 8 -1or transmitting the photograph or other recorded evidence2to a city, county or municipality or a municipal agent.3(2) A municipality or a manufacturer or vendor of an4 automated road safety monitoring system may not use,5 disclose, sell or permit access to data collected by an6 automated road safety monitoring system, except as necessary7 to process enforceable violations in accordance with this8 section.9(3) Photographs and other personal identifying10 information collected by a municipality under this section11 shall not be a public record.12 (j) Use of revenue.--A municipality that authorizes the use13 of automated road safety monitoring systems under this section14 shall use the revenue generated to pay for administration costs15 associated with this section and fund road safety projects with16 the highest potential to reduce vulnerable road user injuries17 and fatalities, including improvements to access and safety for18 road users with mobility, sight or other disabilities.19 (k) Rules and regulations.--The department shall issue rules20 and promulgate regulations necessary to implement this section.21 (l) Construction.--Nothing in this section shall be22 construed to prohibit a law enforcement officer from issuing a23 notice of traffic violation to a person in control of a motor24 vehicle at the time a violation occurs.25 (m) Definitions.--As used in this section, the following26 words and phrases shall have the meanings given to them in this27 subsection unless the context clearly indicates otherwise:28 "Automated road safety monitoring system." An automated29 motor vehicle sensor device that produces digital photographs or30 video of a motor vehicle that commits a violation at the20260HB2556PN3466 - 9 -1 location where the automated motor vehicle sensor device is2 located.3 "Enforceable violations." Any of the following violations of4 traffic law or regulation:5(1) Failure to stop for a stop sign under section 33236 (relating to stop signs and yield signs).7(2) Failure to yield to pedestrian in a crosswalk under8 section 3542 (relating to right-of-way of pedestrians in9 crosswalks).10 "Municipal agent." The entity or person contracted by a11 city, county or municipality to implement, administer or12 otherwise conduct the issuance, processing and collection of13 citations and fines of enforceable violations under this14 section.15 Section 2.
