                               AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2    Statutes, in domestic animals, further providing for
3    definitions and providing for requirements for equines sold
4    by dealer.
5    The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7    Section 1.    The definition of "dealer" in section 2303 of
8 Title 3 of the Pennsylvania Consolidated Statutes is amended and
9 the section is amended by adding definitions to read:
10 § 2303.    Definitions.
11    The following words and phrases when used in this chapter
12 shall have the meanings given to them in this section unless the
13 context clearly indicates otherwise:

15    "Dealer."    A person that buys, receives, sells, exchanges,
16 negotiates or solicits the sale, resale, exchange or transfer of
17 domestic animals or dead domestic animals, including over the
18 Internet OR SIMILAR INTERACTIVE COMMUNICATION MEDIA, for the       <--
1 purpose of transfer of ownership or possession to a third party.

3    "Equine infectious anemia test."      One of the following:
4(1)    An official agar gel immunodiffusion blood test,
5    conducted by a federally approved laboratory within 12 months
6    prior to the date of entry.
7(2)    An enzyme-linked immunosorbent assay test, conducted
8    by a federally approved laboratory within 12 months prior to
9    the date of entry.

11    "Interstate certificate of veterinary inspection."      As
12 defined in section 2501 (relating to definitions).
13    * * *
14    "Person."      An individual or a legally recognized entity.

16    Section 2.      Title 3 is amended by adding a section to read:
17 § 2348.1.      Requirements for equines sold by dealer.
18    (a)   Duty of dealer.--A dealer must comply with the
19 following:
20(1)    Except as provided under paragraph (3), an equine
21    sold by a dealer must have tested negative to an equine
22    infectious anemia test, and proof of the negative result
23    shall accompany the equine.
24(2)    A dealer may use an interstate certificate of  <--
25    veterinary inspection, MUST DETERMINE WHETHER AN EQUINE HAS  <--
26    AN implanted microchip or tattoo or brand.
27(3)    Paragraph (1) shall not apply to a foal under the
28    age of six months which is accompanied by the dam which had a
29    negative equine infectious anemia test.
30    (b)   Required recordkeeping.--For a minimum of two years

1 following the date of sale, for each equine sold by a dealer, a
2 dealer shall maintain the following records:
3(1)    The presence or absence of a microchip, tattoo or
4    brand, including, if present, any identification number
5    contained in the microchip and, if present, a detailed
6    description or photograph of any tattoo or brand found on the
7    equine.
8(2)    The date and time that each equine was sold by a
9    dealer.
10(3)    A copy of proof of equine infectious anemia test.
11    For any equine infectious anemia test collected outside of
12    this Commonwealth, a copy of an interstate certificate of
13    veterinary inspection must accompany the equine infectious
14    anemia test.
15(4)    Any other documentation that the department may
16    require by regulation.
17    (c)   Definitions.--As used in this section, the following
18 words and phrases shall have the meanings given to them in this
19 subsection unless the context clearly indicates otherwise:
20    "Dam."      The mother or female parent of a horse.
21    "Foal."     A young equine under the age of one.
22    Section 3.     This act shall take effect in 90 days.
