The definition of "dealer" in section 2303 of8 Title 3 of the Pennsylvania Consolidated Statutes is amended and9 the section is amended by adding definitions to read:10 § 2303. Definitions.11 The following words and phrases when used in this chapter12 shall have the meanings given to them in this section unless the13 context clearly indicates otherwise:14 * * *15 "Dealer." A person that buys, receives, sells, exchanges,16 negotiates or solicits the sale, resale, exchange or transfer of17 domestic animals or dead domestic animals, including over the18 Internet OR SIMILAR INTERACTIVE COMMUNICATION MEDIA, for the <--1 purpose of transfer of ownership or possession to a third party.2 * * *3 "Equine infectious anemia test." One of the following:4(1) An official agar gel immunodiffusion blood test,5 conducted by a federally approved laboratory within 12 months6 prior to the date of entry.7(2) An enzyme-linked immunosorbent assay test, conducted8 by a federally approved laboratory within 12 months prior to9 the date of entry.10 * * *11 "Interstate certificate of veterinary inspection." As12 defined in section 2501 (relating to definitions).13 * * *14 "Person." An individual or a legally recognized entity.15 * * *16 Section 2. Title 3 is amended by adding a section to read:17 § 2348.1. Requirements for equines sold by dealer.18 (a) Duty of dealer.--A dealer must comply with the19 following:20(1) Except as provided under paragraph (3), an equine21 sold by a dealer must have tested negative to an equine22 infectious anemia test, and proof of the negative result23 shall accompany the equine.24(2) A dealer may use an interstate certificate of <--25 veterinary inspection, MUST DETERMINE WHETHER AN EQUINE HAS <--26 AN implanted microchip or tattoo or brand.27(3) Paragraph (1) shall not apply to a foal under the28 age of six months which is accompanied by the dam which had a29 negative equine infectious anemia test.30 (b) Required recordkeeping.--For a minimum of two years20260HB2555PN3560 - 2 -1 following the date of sale, for each equine sold by a dealer, a2 dealer shall maintain the following records:3(1) The presence or absence of a microchip, tattoo or4 brand, including, if present, any identification number5 contained in the microchip and, if present, a detailed6 description or photograph of any tattoo or brand found on the7 equine.8(2) The date and time that each equine was sold by a9 dealer.10(3) A copy of proof of equine infectious anemia test.11 For any equine infectious anemia test collected outside of12 this Commonwealth, a copy of an interstate certificate of13 veterinary inspection must accompany the equine infectious14 anemia test.15(4) Any other documentation that the department may16 require by regulation.17 (c) Definitions.--As used in this section, the following18 words and phrases shall have the meanings given to them in this19 subsection unless the context clearly indicates otherwise:20 "Dam."
