HOUSE CONCURRENT RESOLUTION 33

Requesting the Joint Committee on Government and Finance to study women’s collegiate sports programs in West Virginia, focusing on financial sustainability, NIL impacts, and existing Title IX obligations.
Whereas, The Legislature finds that women’s collegiate Olympic sports provide essential educational, athletic, and leadership opportunities for students across West Virginia; and
Whereas, Recent changes in the national collegiate landscape, including Name, Image, and Likeness (NIL) regulations and potential "revenue-sharing" models, pose significant financial risks to programs that do not generate high independent revenue; and
Whereas, West Virginia institutions have recently faced "financial considerations" resulting in the elimination of long-standing women's programs; and
Whereas, Protecting the integrity and availability of these programs is a matter of statewide interest to ensure fairness, opportunity, and the tools to succeed for female student-athletes; therefore, be it:
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study the following:
Financial Stability: Current funding levels and the impact of shifting athletic priorities on non-revenue women’s sports at public universities.
Endowment Feasibility: The effectiveness of proposed permanent endowment funds and private-public partnership models in sustaining programs.
NIL & Revenue Sharing: How new NIL laws and potential "student-athlete employee" designations affect women's sports program viability.
Operational Efficiency: Methods for institutions to realize "verified cost savings" that can be redirected to support women's athletics; and, be it:
Further Resolved, That the Joint Committee on Government and Finance shall submit a report by January 1, 2027, on its findings to the Governor, President of the Senate, and the Speaker of the House of Delegates; and be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2027, on it findings, conclusions, and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and be it
Further Resolved, That the expense necessary to conduct this study, to prepare a report, and to draft any necessary legislation be paid from the legislative appropriations to the Joint Committee on Government and Finance.
