 School funding-legislative and executive authority.

                        A JOINT RESOLUTION
                                for
1 A JOINT RESOLUTION to amend the Wyoming Constitution to
2 specify that the amount of the appropriation for school
3 funding shall not be subject to judicial review.

5 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
6 two-thirds of all the members of the two houses, voting
7 separately, concurring therein:

9Section 1.   The following proposal to amend the Wyoming
10 Constitution Article 7, Section 1 is proposed for submission
11 to the electors of the State of Wyoming at the next general
12 election for approval or rejection to become valid as a part
13 of the Constitution if ratified by a majority of the electors
14 at the election:

1Article 7, Section 1.   Legislature to provide for public
2 schools.

4(a)   The legislature shall provide for the establishment
5 and maintenance of a complete and uniform system of public
6 instruction,    embracing   free     elementary   schools    of   every
7 needed kind and grade, a university with such technical and
8 professional departments as the public good may require and
9 the means of the state allow, and such other institutions as
10 may be necessary.

12(b)   Notwithstanding   any     other   provision     of   this
13 constitution, for the operating costs of the public schools,
14 the legislature shall provide a formula for funding, and that
15 formula      shall   be   subject     to   judicial    review      for
16 constitutional compliance. The legislature shall fund the
17 formula by appropriation and the amount of this appropriation
18 shall not be subject to judicial review. In the event the
19 appropriation is insufficient to fund the spending provided
20 by the formula for funding, the spending shall be reduced by
21 a uniform percentage.

1Section 2.   That the Secretary of State shall endorse
2 the following statement on the proposed amendment:

4 This amendment would specify that, for the operating costs of
5 the public schools, the legislature shall provide a formula
6 for funding, and that formula shall be subject to judicial
7 review for constitutional compliance. The amendment would
8 also specify that legislature shall fund the formula by
9 appropriation and the amount of this appropriation shall not
10 be subject to judicial review.
