sb1881/introduced-in-senate.txt119 S1881 IS: Public Service Worker Protection ActU.S. Senate2025-05-22text/xmlENPursuant to Title 17 Section 105 of the United States Code, this file is not subject to copyright protection and is in the public domain.II 119th CONGRESS 1st Session S. 1881 IN THE SENATE OF THE UNITED STATES May 22, 2025 Mr. Markey (for himself, Mr. Schumer , Mr. Sanders , Mr. Luján , Ms. Warren , Mr. Wyden , Mr. Van Hollen , Mr. Padilla , Mr. Blumenthal , Ms. Baldwin , and Mr. Schiff ) introduced the following bill; which was read twice and referred to the Committee on Health, Education, Labor, and Pensions A BILLTo amend the Occupational Safety and Health Act of 1970 to expand coverage under such Act to public employees.1.Short titleThis Act may be cited as the Public Service Worker Protection Act .2.Coverage of public employees(a)In generalSection 3(5) of the Occupational Safety and Health Act of 1970 ( 29 U.S.C. 652(5) ) is amended by striking but does not include and all that follows through the period at the end and inserting including the United States, a State, or a political subdivision of a State. .(b)Rule of ConstructionNothing in this Act shall be construed to affect the application of section 18 of the Occupational Safety and Health Act of 1970 ( 29 U.S.C. 667 ).(c)Effective date(1)In generalSubject to paragraph (2), this Act and the amendment made by this Act, shall take effect on the date that is 90 days after the date of enactment of this Act.(2)Exception for States and political subdivisionsThis Act, and the amendment made by this Act, shall take effect on the date that is 36 months after the date of enactment of this Act with respect to a workplace of a State, or a political subdivision of a State, that does not have a State plan approved under section 18 of the Occupational Safety and Health Act of 1970 ( 29 U.S.C. 667 ).
