To amend title 18, United States Code, by adding an additional aggravating
  factor to be considered in determining whether a sentence of death is
 warranted.
1.
Short title
This Act may be cited as the   Justice for American Victims of Illegal Aliens Act  .
2.
Death penalty aggravating factors
Section 3592(c) of title 18, United States Code, is amended by inserting after paragraph (16) the following:
(17)
Illegal alien
The defendant is an alien who—
(A)
came to, entered, or remains in the United States in violation of Federal law; and
(B)
has been convicted of killing, attempting to kill, or conspiring to kill a United States citizen.
