sb850/engrossed-in-senate.txt114 S850 ES: Northern Border Security Enhancement and Review ActU.S. Senatetext/xmlENPursuant to Title 17 Section 105 of the United States Code, this file is not subject to copyright protection and is in the public domain.119th CONGRESS 2d Session S. 850 IN THE SENATE OF THE UNITED STATES AN ACTTo amend the Northern Border Security Review Act to require updates to the northern border threat analysis and northern border strategy, and for other purposes.1.Short titleThis Act may be cited as the Northern Border Security Enhancement and Review Act .2.Northern border threat analysis and strategy(a)Northern border threat analysisSection 3(a) of the Northern Border Security Review Act ( Public Law 114–267 ) is amended—(1)in the matter preceding paragraph (1), by striking 180 days after the date of enactment of this Act and inserting 180 days after the date of the enactment of the Northern Border Security Enhancement and Review Act , and every 3 years thereafter ;(2)by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5), respectively; and(3)by inserting after paragraph (1) the following:(2)an assessment of recent changes in the amount and demographics of apprehensions at the Northern Border, including an analysis of apprehension changes at the sector level..(b)Northern border strategy updatesSection 3 of the Northern Border Security Review Act ( Public Law 114–267 ) is amended—(1)by redesignating subsection (c) as subsection (d); and(2)by inserting after subsection (b) the following:(c)Northern border strategy updatesThe Secretary of Homeland Security shall update the Department of Homeland Security’s Northern Border strategy not later than 18 months after the date of the enactment of the Northern Border Security Enhancement and Review Act , and every 5 years thereafter, and shall incorporate the results of the most recent threat analysis in each such update..(c)Classified briefingsSection 3 of the Northern Border Security Review Act, as amended by subsections (a) and (b), is further amended by adding at the end the following:(e)Classified briefingsNot later than 30 days after the submission of each threat analysis pursuant to subsection (a), the Secretary of Homeland Security shall provide a classified briefing regarding such analysis to the appropriate congressional committees..(d)Implementation of certain Government Accountability Office recommendationsNot later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Executive Assistant Commissioner of Air and Marine Operations of U.S. Customs and Border Protection, shall develop performance measures to assess the effectiveness of Air and Marine Operations at securing the northern border between ports of entry in the air and maritime environments.3.No additional fundsNo additional funds are authorized to be appropriated for the purpose of carrying out this Act or the amendments made by this Act.Passed the Senate August 5, 2026. Northern Border Security Enhancement and Review Act
This bill requires the Department of Homeland Security (DHS) to regularly perform a threat analysis of the northern U.S. border.
The analysis must be performed every three years and include terroristic and criminal threats, recent changes in apprehensions, and improvements needed to prevent terrorism and reduce criminal activity.
DHS must update its northern border strategy not later than September 2, 2026, and every five years thereafter, incorporating the results from the latest threat analysis. DHS must also provide a classified briefing to the appropriate congressional committees.
U.S. Customs and Border Protection’s Air and Marine Operations (AMO) must develop performance metrics to assess the AMO’s effectiveness at securing the northern border between ports of entry in air and maritime environments.
