To require mandatory minimums for sexual abuse.
1.
Short title
This Act may be cited as the   Justice for Rape Survivors Act  .
2.
Mandatory minimums for sexual abuse
(a)
Aggravated sexual abuse
Section 2241 of title 18, United States Code, is amended—
(1)
in subsection (a), by striking  imprisoned for any term of years or life,  and inserting  imprisoned for not less than 30 years or for life, ; and
(2)
in subsection (b), by striking  imprisoned for any term of years or life,  and inserting  imprisoned for not less than 30 years or for life, .
(b)
Sexual abuse
Section 2242 of title 18, United States Code, is amended by striking  imprisoned for any term of years or for life  and inserting  imprisoned for not less than 30 years or for life .

Justice for Rape Survivors Act

This bill establishes a 30-year statutory mandatory minimum prison term for the following federal sexual abuse offenses:

  • causing another person to engage in a sexual act by using force against that person or by threatening or placing that person in fear,
  • engaging in or attempting to engage in a sexual act with another person by rendering the other person unconscious or intoxicated,
  • causing or attempting to cause another person to engage in a sexual act by threatening or placing that person in fear,
  • engaging or attempting to engage in a sexual act if the other person is incapacitated, and
  • engaging or attempting to engage in a sexual act without the other person's consent.
