  To amend title 28, United States Code, to limit the enforce-
  ment of foreign censorship judgments, and for other
  purposes.
1Be it enacted by the Senate and House of Representa-
  2 tives of the United States of America in Congress assembled,
3   SECTION 1. SHORT TITLE.
4This Act may be cited as the ‘‘Guaranteeing Rights
  5 Against Novel International Tyranny and Extortion Act’’
  6 or the ‘‘GRANITE Act’’.

1   SEC. 2. LIMITATION ON ENFORCEMENT OF FOREIGN CEN-
2SORSHIP JUDGMENTS.
3(a) IN GENERAL.—Chapter 181 of title 28, United
  4 States Code, is amended by adding at the end the fol-
  5 lowing:
  6 ‘‘§ 4106. Limitation on enforcement of foreign censor-
7ship judgments
8‘‘(a) LIMITATION  ON        ENFORCEMENT.—Notwith-
  9 standing any other provision of Federal or State law, a
  10 domestic court shall not recognize or enforce a foreign
  11 judgment, or a fine, order, or demand issued by a foreign
  12 court or a foreign state, enforcing a foreign censorship
  13 law.
14‘‘(b) RIGHT OF ACTION.—A United States person
  15 against whom a foreign judgment described in subsection
  16 (a) is entered, or upon whom a judgment, fine, order, or
  17 demand described in subsection (a) is served or purport-
  18 edly served, may bring an action in an appropriate district
  19 court of the United States seeking declaratory relief that
  20 such judgment, fine, order, or demand is unenforceable
  21 under subsection (a).
22‘‘(c) DEFINITION.—In this section:
23‘‘(1) The term ‘foreign censorship law’ means
24any law of a foreign state that—

25‘‘(A)(i) has the primary purpose or sub-
26stantial effect of restricting or penalizing ex-

1pression, expressive conduct, or expressive asso-
2ciation;
3‘‘(ii) targets expression, expressive
4conduct, or expressive association based on
5its content, viewpoint, or speaker identity;
6or
7‘‘(iii) compels disclosure that would
8reasonably chill that expression, expressive
9conduct, or expressive association; and
10‘‘(B) would conflict with the protections of
11the First Amendment of the United States Con-
12stitution if recognized in the United States.
13‘‘(2) The term ‘foreign state’ has the meaning
14given such term in section 1603.’’.
15(b) NO SOVEREIGN IMMUNITY.—Section 1605(a) of
  16 title 28, United States Code, is amended—
17(1) in paragraph (5), by striking ‘‘or’’ at the
18end;
19(2) in paragraph (6), by striking the period at
20the end and inserting ‘‘; or’’; and
21(3) by adding at the end the following:
22‘‘(7) under section 4106.’’.

1(c) CLERICAL AMENDMENT.—Chapter 181 of title
  2 28, United States Code, is amended by inserting after the
  3 item relating to section 4105 the following:
  ‘‘4106. Limitation on enforcement of foreign censorship judgments.’’.
