                                AN ACT
1 Amending Title 68 (Real and Personal Property) of the
2    Pennsylvania Consolidated Statutes, in seller disclosures,
3    providing for owners' associations disclosure requirements.
4    The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6    Section 1.    Title 68 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 7316.   Owners' associations disclosure requirements.
9    (a)    Owners' associations disclosure requirements.--All real
10 estate transactions involving properties in homeowners'
11 associations and condominium owners' associations shall include
12 full disclosure of infrastructure ownership and clearly defined
13 maintenance responsibilities, including roads, culverts, storm
14 water facilities, public safety lighting and inspection fees.
15    (b)    Penalties.--Failure to provide the disclosures under
16 subsection (a) before closing shall result in the following
17 penalties against a homeowners' association or condominium
18 owners' association:
1(1)   $5,000 for a first violation.
2(2)   $10,000 for a second violation.
3(3)   $15,000 for a third and subsequent violation.
4    Section 2.   This act shall apply to each closing on
5 residential property occurring after the effective date of this
6 section.
7    Section 3.   This act shall take effect in 60 days.
