R. 10119 IN THE HOUSE OF REPRESENTATIVES August 20, 2026 Mr. Barrett introduced the following bill; which was referred to the Committee on Energy and Commerce A BILLTo prohibit the preemption of State or local land-use, zoning, siting, or permitting authority for data centers on non-Federal land, and for other purposes.1.Short titleThis Act may be cited as the Protecting Local Control of Data Centers Act .2.No preemption of State or local land-use, zoning, siting, or permitting authority for data centersNotwithstanding any other provision of law, the head of a Federal agency may not override, bypass, or displace State or local land-use, zoning, siting, or permitting authority for data centers located on non-Federal land, or condition the receipt of Federal funds for such data centers on a State or local government relinquishing or limiting such authority.
