                                 AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2    Pennsylvania Consolidated Statutes, in sentencing, further
3    providing for modification or revocation of order of
4    probation.
5    The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7    Section 1.      Section 9771(c)(2)(i), (ii) and (iii) of Title 42
8 of the Pennsylvania Consolidated Statutes are amended to read:
9 § 9771.    Modification or revocation of order of probation.

11    (c)    Limitation on sentence of total confinement.--There is a
12 presumption against total confinement for technical violations
13 of probation. The following shall apply:

15(2)   If a court imposes a sentence of total confinement
16    following a revocation, the basis of which is for one or more
17    technical violations under paragraph (1)(ii) or (iii), the
18    court shall consider the employment status of the defendant.
19    The defendant shall be sentenced as follows:
1(i)    For a first hearing in which one or more
2      technical [violation,] violations are found, a maximum
3      period of 14 days.
4(ii)    For a second hearing in which one or more
5      technical [violation,] violations are found, a maximum
6      period of 30 days.
7(iii)    For a third or subsequent hearing in which one
8      or more technical [violation,] violations are found, the
9      court may impose any sentencing alternatives available at
10      the time of initial sentencing.

12  Section 2.     This act shall take effect in 60 days.
