Section 9771(c)(2)(i), (ii) and (iii) of Title 428 of the Pennsylvania Consolidated Statutes are amended to read:9 § 9771. Modification or revocation of order of probation.10 * * *11 (c) Limitation on sentence of total confinement.--There is a12 presumption against total confinement for technical violations13 of probation. The following shall apply:14* * *15(2) If a court imposes a sentence of total confinement16 following a revocation, the basis of which is for one or more17 technical violations under paragraph (1)(ii) or (iii), the18 court shall consider the employment status of the defendant.19 The defendant shall be sentenced as follows:1(i) For a first hearing in which one or more2 technical [violation,] violations are found, a maximum3 period of 14 days.4(ii) For a second hearing in which one or more5 technical [violation,] violations are found, a maximum6 period of 30 days.7(iii) For a third or subsequent hearing in which one8 or more technical [violation,] violations are found, the9 court may impose any sentencing alternatives available at10 the time of initial sentencing.11* * *12 Section 2.
