 AN ACT to amend the penal law, in relation  to  criminal  possession  of
   stolen property in the third, second and first degrees
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
   Section 1. Section 165.50 of the penal law, as amended by chapter  515
 of the laws of 1986, is amended to read as follows:
 § 165.50 Criminal possession of stolen property in the third degree.
   A  person  is  guilty of criminal possession of stolen property in the
 third degree when [he] SUCH PERSON knowingly possesses stolen  property,
 with  intent  to  benefit  [himself]  THEMSELF or a person other than an
 owner thereof or to impede the recovery by an owner thereof, and when:
   1. the value of the property exceeds three thousand dollars; OR
   2. REGARDLESS OF THE VALUE OF SUCH PROPERTY, SUCH PROPERTY IS  COMMER-
 CIAL PROPERTY.
   Criminal  possession of stolen property in the third degree is a class
 D felony.
   § 2. Section 165.52 of the penal law, as added by chapter 515  of  the
 laws of 1986, is amended to read as follows:
 § 165.52 Criminal possession of stolen property in the second degree.
   A  person  is  guilty of criminal possession of stolen property in the
 second degree when [he] SUCH PERSON knowingly possesses stolen property,
 with intent to benefit [himself] THEMSELF or  a  person  other  than  an
 owner thereof or to impede the recovery by an owner thereof, and when:
   1. the value of the property exceeds fifty thousand dollars; OR
   2.  REGARDLESS OF THE VALUE OF SUCH PROPERTY, SUCH PROPERTY IS (A) ONE
 RESIDENTIAL REAL PROPERTY, AS DEFINED BY SECTION 187.00 OF THIS PART;
   (B) ONE COMMERCIAL PROPERTY THAT IS MIXED-USE PROPERTY WITH  AT  LEAST
 ONE RESIDENTIAL UNIT; OR
   (C) TWO OR MORE COMMERCIAL PROPERTIES.
   Criminal possession of stolen property in the second degree is a class
 C felony.

   §  3.  Section 165.54 of the penal law, as added by chapter 515 of the
 laws of 1986, is amended to read as follows:
 § 165.54 Criminal possession of stolen property in the first degree.
   A  person  is  guilty of criminal possession of stolen property in the
 first degree when [he] SUCH PERSON knowingly possesses stolen  property,
 with  intent  to  benefit  [himself]  THEMSELF or a person other than an
 owner thereof or to impede the recovery by an owner, and when:
   1. the value of the property exceeds one million dollars; OR
   2. REGARDLESS OF THE VALUE OF SUCH  PROPERTY,  SUCH  PROPERTY  IS  (A)
 RESIDENTIAL  REAL  PROPERTY,  AS DEFINED BY SECTION 187.00 OF THIS PART,
 THAT IS OCCUPIED AS A HOME BY AT LEAST ONE PERSON;
   (B) RESIDENTIAL REAL PROPERTY, AS DEFINED BY SECTION  187.00  OF  THIS
 PART,  THAT  IS OWNED BY AN ELDERLY PERSON, AN INCOMPETENT, AN INCAPACI-
 TATED PERSON, OR A PHYSICALLY DISABLED PERSON; OR
   (C) THREE OR MORE RESIDENTIAL REAL PROPERTIES, AS DEFINED  BY  SECTION
 187.00 OF THIS PART.
   Criminal  possession of stolen property in the first degree is a class
 B felony.
   § 4. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
