                               AN ACT
1 Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An
2    act relating to alcoholic liquors, alcohol and malt and
3    brewed beverages; amending, revising, consolidating and
4    changing the laws relating thereto; regulating and
5    restricting the manufacture, purchase, sale, possession,
6    consumption, importation, transportation, furnishing, holding
7    in bond, holding in storage, traffic in and use of alcoholic
8    liquors, alcohol and malt and brewed beverages and the
9    persons engaged or employed therein; defining the powers and
10    duties of the Pennsylvania Liquor Control Board; providing
11    for the establishment and operation of State liquor stores,
12    for the payment of certain license fees to the respective
13    municipalities and townships, for the abatement of certain
14    nuisances and, in certain cases, for search and seizure
15    without warrant; prescribing penalties and forfeitures;
16    providing for local option, and repealing existing laws," in
17    licenses and regulations and liquor, alcohol and malt and
18    brewed beverages, further providing for sales by liquor
19    licensees and restrictions, providing for event permits and
20    further providing for unlawful acts relative to malt or
21    brewed beverages and licensees.
22    The General Assembly of the Commonwealth of Pennsylvania
23 hereby enacts as follows:
24    Section 1.    Section 406(a)(2) and (4) of the act of April 12,
25 1951 (P.L.90, No.21), known as the Liquor Code, are amended to
26 read:
27    Section 406.    Sales by Liquor Licensees; Restrictions.--(a)

1    (2)   [Hotel] Except as provided under section 418, hotel and
2 restaurant liquor licensees, municipal golf course restaurant
3 liquor licensees and privately-owned public golf course
4 restaurant licensees may sell liquor and malt or brewed
5 beverages only after seven o'clock antemeridian of any day until
6 two o'clock antemeridian of the following day, except Sunday,
7 and except as hereinafter provided, may sell liquor and malt or
8 brewed beverages on Sunday between the hours of twelve o'clock
9 midnight and two o'clock antemeridian.

11    (4)   Hotel and restaurant liquor licensees, municipal golf
12 course restaurant liquor licensees and privately-owned public
13 golf course restaurant licensees which do not qualify for and
14 purchase such special permit, their servants, agents or employes
15 may sell liquor and malt or brewed beverages only after seven
16 o'clock antemeridian of any day and until two o'clock
17 antemeridian of the following day, and shall not sell after two
18 o'clock antemeridian on Sunday, except as provided under section
19 418. No club licensee or its servants, agents or employes may
20 sell liquor or malt or brewed beverages between the hours of
21 three o'clock antemeridian and seven o'clock antemeridian on any
22 day, except as provided under section 418. No public service
23 liquor licensee or its servants, agents, or employes may sell
24 liquor or malt or brewed beverages between the hours of two
25 o'clock antemeridian and seven o'clock antemeridian on any day.

27    Section 2.   The act is amended by adding a section to read:
28    Section 418.   Event Permits.--(a)    The following licensees
29 may apply to the board for an event permit:
30    (1)   A hotel liquor licensee.

1    (2)   A restaurant liquor licensee.
2    (3)   A club liquor licensee.
3    (4)   A retail dispenser.
4    (5)   A club retail dispenser.
5    (6)   A brewery licensee.
6    (7)   A brew pub licensee.
7    (8)   A limited winery licensee.
8    (9)   A limited distillery licensee.
9    (b)   Subject to subsections (c), (d) and (e), an event permit
10 shall authorize the permit holder to sell liquor or malt or
11 brewed beverages in accordance with the permit holder's
12 underlying license beginning at six o'clock antemeridian on the
13 day of the event and ending at four o'clock antemeridian on the
14 following day.
15    (c)   An event permit shall not authorize sales on Sunday
16 unless the permit holder holds a permit authorizing Sunday sales
17 or is otherwise authorized under this act to sell on Sunday.
18    (d)   If the permit holder is authorized under this act to
19 sell on Sunday, the following shall apply:
20    (1)   If the event begins on Sunday, sales may begin at six
21 o'clock antemeridian on Sunday and continue until four o'clock
22 antemeridian on Monday.
23    (2)   If the event begins on Saturday, sales may begin at six
24 o'clock antemeridian on Saturday and continue until four o'clock
25 antemeridian on Sunday.
26    (e)   If the permit holder is not authorized under this act to
27 sell on Sunday, the following shall apply:
28    (1)   If the event begins on Saturday, sales may begin at six
29 o'clock antemeridian on Saturday and continue until two o'clock
30 antemeridian on Sunday.

1    (2)   The permit holder may not obtain an event permit for an
2 event beginning on Sunday.
3    (f)   A licensee applying for an event permit shall pay a fee
4 of five hundred dollars ($500) for the first event permit issued
5 to the licensee in a calendar year. No additional fee shall be
6 charged for a subsequent event permit issued to the same
7 licensee in the same calendar year. Fees paid under this
8 subsection shall be deposited into The State Stores Fund. A fee
9 paid under this subsection shall be nonrefundable.
10    (g)   A licensee must apply for an event permit at least sixty
11 (60) days before the day of the event.
12    (h)   The board may approve or disapprove an application for
13 an event permit if the applicant:
14    (1)   failed to provide timely notice of the event;
15    (2)   does not intend to conduct an event that meets the
16 requirements of this act;
17    (3)   previously conducted an event that did not meet the
18 requirements of this act; or
19    (4)   is otherwise in violation of this act or the board's
20 regulations.
21    (i)   An event permit shall be valid for one event only.
22    (j)   Event permits issued to the same licensee may not be
23 used fewer than six (6) days apart, as measured from the first
24 day of each event.
25    (k)   A licensee may not be issued more than ten event permits
26 in a calendar year.
27    (l)   At least thirty (30) days before the day of the event,
28 the permit holder shall provide written notice to the board. The
29 board may waive the notice requirement under this subsection.
30    (m)   At least seven (7) days before the day of the event, the

1 permit holder shall provide written notice of the event to the
2 enforcement bureau and to the local police department or, if
3 there is no local police department, to the Pennsylvania State
4 Police.
5    (n)    A violation of this act or the board's regulations
6 governing conduct under an event permit may constitute a basis
7 for any of the following:
8    (1)    The issuance of a citation under section 471.
9    (2)    The nonrenewal of the underlying license under section
10 470.
11    (3)    The refusal by the board to issue a subsequent event
12 permit to the licensee.
13    (o)    The remedies under subsection (n) shall be in addition
14 to any other remedy available to the board or the enforcement
15 bureau.
16    Section 3.    Section 492(5) and (7) of the act are amended to
17 read:
18    Section 492.    Unlawful Acts Relative to Malt or Brewed
19 Beverages and Licensees.--
20    It shall be unlawful--

22    (5)    Sales of Malt or Brewed Beverages by Hotels, Eating
23 Places or Public Service Licensees During Prohibited Hours.--
24 [For] Except as provided under section 418, for any hotel or
25 eating place holding a retail dispenser's license, or the
26 servants, agents or employes of such licensees, to sell, trade
27 or barter in malt or brewed beverages between the hours of two
28 o'clock antemeridian Sunday and seven o'clock in the forenoon of
29 the following Monday, or between the hours of two o'clock
30 antemeridian and seven o'clock antemeridian of any week day:

1 Provided, That notwithstanding any provision to the contrary,
2 whenever the thirty-first day of December falls on a Sunday such
3 sales of malt or brewed beverages may be made on such day after
4 one o'clock postmeridian and until two o'clock antemeridian of
5 the following day. For any public service licensee authorized to
6 sell malt or brewed beverages or the servants, agents or
7 employes of such licensees to sell, trade or barter in malt or
8 brewed beverages between the hours of two o'clock antemeridian
9 and seven o'clock antemeridian on any day.
10    (7)   Clubs Selling Between Three O'Clock Antemeridian and
11 Seven O'Clock Antemeridian. [For] Except as provided under
12 section 418, for any club retail dispenser, or its servants,
13 agents or employes, to sell malt or brewed beverages between the
14 hours of three o'clock antemeridian and seven o'clock
15 antemeridian on any day.

17    Section 4.   This act shall take effect in 60 days.
