HARRIS, KHAN, HILL-EVANS, GAYDOS, SANCHEZ, INGLIS AND SMITH-WADE-EL,APRIL 20, 2026REFERRED TO COMMITTEE ON HOUSING AND COMMUNITY DEVELOPMENT,APRIL 21, 2026AN ACT1 Amending the act of November 10, 1999 (P.L.491, No.45), entitled2 "An act establishing a uniform construction code; imposing3 powers and duties on municipalities and the Department of4 Labor and Industry; providing for enforcement; imposing5 penalties; and making repeals," in training and certification6 of inspectors, further providing for education and training7 programs and providing for the Residential Construction8 Workforce Training Grant Program; and establishing the9 Residential Construction Workforce Training Account.10 The General Assembly of the Commonwealth of Pennsylvania11 hereby enacts as follows:12 Section 1. Section 703(b) of the act of November 10, 199913 (P.L.491, No.45), known as the Pennsylvania Construction Code14 Act, is amended, subsections (c) and (d) are amended by adding15 paragraphs and the section is amended by adding a subsection to16 read:17 Section 703. Education and training programs.18 * * *19 (a.1) Optional fee.--Municipalities administering and20 enforcing this act under section 501(a) may, by ordinance,1 assess a fee not to exceed $10 on each residential construction2 or building permit.3 (b) Accounts.--There are hereby established within the State4 Treasury [three] four restricted accounts which shall be known5 as the Municipal Code Official Training Account, the Review and6 Advisory Council Administration Account [and], the Construction7 Contractor Training Account and the Residential Construction8 Workforce Training Account.9 (c) Deposit.--10* * *11(4) The fee collected as authorized under subsection12 (a.1) shall be transmitted quarterly to the State Treasury13 and shall be deposited into the Residential Construction14 Workforce Training Account. Money in the Residential15 Construction Workforce Training Account is appropriated on a16 continuing basis to the department for the purpose of17 awarding grants under section 703.1.18 (d) Reports.--19* * *20(3) No later than November 1 of each calendar year, the21 department shall provide a report to the chairperson and22 minority chairperson of the Labor and Industry Committee of23 the Senate and the chairperson and minority chairperson of24 the Labor and Industry Committee of the House of25 Representatives. The report shall detail expenditures for the26 most recent fiscal year. The report shall include a separate27 accounting of revenue and expenditures under subsection (c)28 (4). The separate accounting under this paragraph shall29 include, to the extent available:30(i) Fees deposited into the Residential Construction20260HB2428PN3234 - 2 -1Workforce Training Account.2(ii) Grants awarded under the Residential3Construction Workforce Training Grant Program.4(iii) Geographic distribution of grants awarded5under the Residential Construction Workforce Training6Grant Program.7(iv) Workforce outcomes of grants awarded under the8Residential Construction Workforce Training Grant9Program.10(v) The amount utilized by the department for11personnel, including the position title, hours charged,12amount and description of the duties and responsibilities13of each individual paid in whole or in part from the14Residential Construction Workforce Training Account.15(vi) The amount utilized by the department for16operational costs and a description of each expenditure.17(vii) The amount utilized by the department for18other Residential Construction Workforce Training Grant19Program purposes and a description of each expenditure.20 Section 2. The act is amended by adding a section to read:21 Section 703.1. Residential Construction Workforce Training22Grant Program.23 (a) Establishment.--The Residential Construction Workforce24 Training Grant Program is established within the department.25 (b) Award of grants.--26(1) The department shall award grants to the extent that27 money is available in the account for the purpose of28 addressing skilled labor shortages impacting the residential29 housing construction needs of the Commonwealth.30(2) Grants shall be awarded to nonprofit organizations,20260HB2428PN3234 - 3 -1 educational institutions, career and technical education2 providers, registered apprenticeship or preapprenticeship3 programs, workforce development organizations or units of4 local government.5(3) Grant awards shall be used for construction6 workforce training, apprenticeships, tools, equipment and7 instructional materials, including transportation assistance8 and stipends, funded in whole or in part by the fee.9(4) Grant awards shall be directed to the building of10 more residential units in this Commonwealth in the county11 from which the fee originated.12 (c) Prioritization.--The department shall prioritize grant13 awards within a county or municipality in which a fee is14 collected.15 (d) Guidelines.--In addition to the reporting requirements16 under section 703(d), the department shall administer the17 account and shall establish guidelines, application procedures18 and reporting requirements necessary to implement this section.19 (e) Definitions.--The following words and phrases when used20 in this section shall have the meanings given to them in this21 section unless the context clearly indicates otherwise:22 "Account." The Residential Construction Workforce Training23 Account established under section 703(b).24 "Fee." The optional fee imposed under section 703(a.1).25 Section 3.
