WARD, BARTOLOTTA, PHILLIPS-HILL, HUTCHINSON,LANGERHOLC, STEFANO, MARTIN, BAKER AND VOGEL, APRIL 17, 2026AS AMENDED ON THIRD CONSIDERATION, MAY 6, 2026AN ACT1 Amending the act of December 15, 1986 (P.L.1585, No.174),2 entitled "An act defining and providing for the licensing and3 regulation of private schools; establishing the State Board4 of Private Licensed Schools; imposing penalties; and making5 repeals," further providing for penalties.6 The General Assembly of the Commonwealth of Pennsylvania7 hereby enacts as follows:8 Section 1. Section 15 of the act of December 15, 19869 (P.L.1585, No.174), known as the Private Licensed Schools Act,10 is amended by adding a subsection to read:11 Section 15. Penalties.12 * * *13 (b.1) Unlicensed training schools and programs.--In addition <--14 to any other penalty provided in this act, the board may, by a15 majority vote of its statutorily authorized membership, levy a16 civil penalty of up to $25,000 on any person who provides17 training without being properly licensed under this act. A civil18 penalty may only be assessed once per violation. Prior to the19 collection of the penalty, the person shall have access to the1 hearing procedure provided in Title 2 of the Pennsylvania2 Consolidated Statutes.3 (B.1) UNLICENSED COMMERCIAL DRIVING SCHOOLS.--IN ADDITION TO <--4 ANY OTHER PENALTY PROVIDED IN THIS ACT, THE BOARD MAY, BY A5 MAJORITY VOTE OF ITS STATUTORILY AUTHORIZED MEMBERSHIP, LEVY A6 CIVIL PENALTY OF UP TO $25,000 ON ANY PERSON WHO PROVIDES ENTRY7 LEVEL DRIVER TRAINING AS REQUIRED BY 49 CFR PT. 380 SUBPT. F8 (RELATING TO ENTRY LEVEL DRIVER TRAINING REQUIREMENTS ON AND9 AFTER FEBRUARY 7, 2022) WITHOUT BEING PROPERLY LICENSED UNDER10 THIS ACT. A CIVIL PENALTY MAY ONLY BE ASSESSED ONCE PER11 VIOLATION. PRIOR TO THE COLLECTION OF THE PENALTY, THE PERSON12 SHALL HAVE ACCESS TO THE HEARING PROCEDURE PROVIDED IN TITLE 213 OF THE PENNSYLVANIA CONSOLIDATED STATUTES.14 * * *15 Section 2.
