hf2780/enrolled.txtHouseFile2780-EnrolledHouseFile2780ANACTRELATINGTOALCOHOLICBEVERAGECONTROLBYPROVIDINGFORCERTIFICATESOFCOMPLIANCEANDTHEISSUANCEOFCLASS“A”WINEPERMITSTONONNATIVEWINEMANUFACTURERS,PERMITTINGCITIESTOCREATESOCIALDISTRICTSFORTHECONSUMPTIONOFALCOHOLICBEVERAGES,ANDPROVIDINGFEES.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:Section1.Section123.3,subsection40,paragraphc,Code2026,isamendedtoreadasfollows:c.Notwithstandingparagraph“e”,theapplicantisacitizenoftheUnitedStatesandaresidentofthisstate,orlicensedtodobusinessinthisstateinthecaseofacorporation.Notwithstandingparagraph“e”,inthecaseofapartnership,onlyonegeneralpartnerneedbearesidentofthisstate.Theresidencyrequirementsofthisparagraphdonotapplytoanapplicantforaclass“A”winepermitissuedtoanonnativewinemanufacturerpursuanttosection123.176A.Sec.2.Section123.23,subsection1,Code2026,isamendedtoreadasfollows:1.Anymanufacturer,distiller,orimporterofalcoholicliquorsshipping,selling,orhavingalcoholicliquorsbroughtintothisstateforresalebythestatedepartmentshall,asaconditionprecedenttotheprivilegeofsotraffickinginalcoholicliquorsinthisstate,annuallymakeapplicationforandholdadistiller’scertificateofcompliancewhichshallHouseFile2780,p.2beissuedbythedirectorforthatpurpose.NoAbrandofalcoholicliquorbroughtintothisstateshallnotbesoldbythedepartmentinthisstateunlessthemanufacturer,distiller,orimporter,andallotherpersonsparticipatinginthedistributionofthatbrandinthisstatehavehasobtainedacertificate.Thecertificateofcomplianceshallexpireattheendofoneyearfromthedateofissuanceandshallberenewedforalikeperioduponapplicationtothedirectorunlessotherwisesuspendedorrevokedforcause.Eachcompletedapplicationforacertificateofcomplianceorrenewalshallbesubmittedelectronically,orinamannerprescribedbythedirector,andshallbeaccompaniedbyafeeoftwohundreddollarspayabletothedepartment.However,thissubsectionneednotapplytoamanufacturer,distiller,orimporterwhoshipsorsellsinthisstatenomorethanelevengallonsoritscaseequivalentduringanyfiscalyearasaresultof“specialorders”whichmightbeplaced,asdefinedandallowedbydepartmentalrulesadoptedunderthischapter.Sec.3.Section123.23,subsection5,Code2026,isamendedbystrikingthesubsection.Sec.4.Section123.30,subsection5,paragrapha,Code2026,isamendedbyaddingthefollowingnewsubparagraph:NEWSUBPARAGRAPH.(4)Asocialdistrict,iftheholderoftheretailalcohollicenseisaparticipatinglicenseewithinasocialdistrictandincompliancewiththeordinanceadoptedundersection414.34.Sec.5.Section123.46,subsection2,Code2026,isamendedtoreadasfollows:2.a.Apersonshallnotuseorconsumealcoholicliquor,wine,orbeeruponthepublicstreetsorhighways.Apersonshallnotuseorconsumealcoholicliquorinanypublicplaceexceptpremisescoveredbyaretailalcohollicense.Apersonshallnotpossessorconsumealcoholicliquors,wine,orbeeronpublicschoolpropertyorwhileattendingapublicorprivateschool-relatedfunction.Apersonshallnotbeintoxicatedinapublicplace.Apersonviolatingthissubsectionisguiltyofasimplemisdemeanor.b.Notwithstandingparagraph“a”,apersonmaypossessorconsumealcoholicliquor,wine,orbeeruponthepublicHouseFile2780,p.3streets,highways,orpublicplaceswithinasocialdistrictifthepossessionorconsumptioncomplieswiththeordinanceadoptedundersection414.34.Sec.6.Section123.135,subsections1,2,and3,Code2026,areamendedtoreadasfollows:1.Amanufacturer,brewer,bottler,importer,orvendorofbeer,oranyagentthereof,desiringtoshiporsellbeer,orhavebeerbroughtintothisstateforresalebyaclass“A”beerpermittee,shallfirstmakeapplicationforandbeissuedabrewer’scertificateofcompliancebythedirectorforthatpurpose.Thecertificateofcomplianceexpiresattheendofoneyearfromthedateofissuanceandshallberenewedforalikeperioduponapplicationtothedirectorunlessotherwiserevokedforcause.Eachcompletedapplicationforacertificateofcomplianceorrenewalofacertificateshallbesubmittedelectronically,orinamannerprescribedbythedirector,andshallbeaccompaniedbyafeeoftwohundreddollarspayabletothedepartment.Eachholderofacertificateofcomplianceshallfurnishtheinformationinamannerthedirectorrequires.Theholderofabrewer’scertificateofcompliancemayalsoholdaclass“A”beerpermit.2.Atthetimeofapplyingforacertificateofcompliance,eachapplicantshallfilewiththedepartmentelectronically,orinamannerprescribedbythedirector,alistofallclass“A”beerpermitteeswithwhomitintendstodobusinessandshalldesignateadesignationofthegeographicareainwhichitsproductsaretobedistributedbysuchpermittee.Thelistingofclass“A”beerpermitteesandgeographicareaasfiledwiththedepartmentshallbeamendedbytheholderofacertificateofcomplianceasnecessarytokeepthelistingcurrentwiththedepartment.3.Allclass“A”beerpermitholdersshallsellonlythosebrandsofbeerbroughtintothestatewhicharemanufactured,brewed,bottled,shipped,orimportedbyapersonholdingacurrentcertificateofcompliance.Anyemployeeoragentworkingfororrepresentingtheholderofacertificateofcompliancewithinthisstateshallsubmitelectronically,orinamannerprescribedbythedirector,theemployee’soragent’sHouseFile2780,p.4nameandaddresswiththedepartment.Sec.7.Section123.173,subsection2,Code2026,isamendedtoreadasfollows:2.Aclass“A”winepermitallowstheholdertomanufactureandsell,orsellatwholesale,inthisstate,wine.Theholderofaclass“A”winepermitmaymanufactureinthisstatewinehavinganalcoholiccontentgreaterthanseventeenpercentbyweightortwenty-oneandtwenty-fivehundredthspercentofalcoholbyvolumeforshipmentoutsidethisstate.AllExceptasprovidedinsection123.176A,allclass“A”premisesshallbelocatedwithinthestate.Sec.8.Section123.175,subsection2,paragraphc,Code2026,isamendedtoreadasfollows:c.ThattheapplicantisacitizenresidentofthestateofIowaor,ifacorporation,thattheapplicantisauthorizedtodobusinessinthestate.ThisparagraphdoesnotapplyiftheapplicantisthestateofIowaorastateagencyasdefinedinsection669.2.Theresidencyrequirementofthisparagraphdoesnotapplytoanonnativewinemanufacturerundersection123.176A.Sec.9.NEWSECTION.123.176ANonnativewinemanufacturers.1.Asusedinthissection,“nonnativewinemanufacturer”meansapersonwhoprocessesthefruit,vegetables,dandelions,clover,honey,oranycombinationoftheseingredients,byfermentationintowinesonapremiseslocatedoutsideofthisstate.2.Anonnativewinemanufacturerlicensedorpermittedpursuanttolawsregulatingalcoholicbeveragesinanotherstatemayapplyforandbeissuedaclass“A”winepermit,asprovidedinsection123.175,withoutbeingaresidentofthisstate.3.Anonnativewinemanufacturerholdingaclass“A”winepermitmaysell,orsellatwholesale,inthisstate,winethatthenonnativewinemanufacturerhasitselfmanufacturedbyfermentationonitsout-of-statelicensedorpermittedpremises,providedthewineisproperlyregisteredwiththealcoholandtobaccotaxandtradebureauoftheUnitedStatesdepartmentofthetreasury.Pursuanttosection123.177,suchsalesshallonlybemadetopersonsholdingaclass“A”wineHouseFile2780,p.5permitortopersonsholdingaretailalcohollicense.4.Anonnativewinemanufacturershallnotsellinthisstatewinefermentedbyanothermanufacturer.5.Anonnativewinemanufacturermayshipwineinclosedcontainerstoindividualpurchaserswithinthisstatebyobtainingawinedirectshipperpermitpursuanttosection123.187.6.Anonnativewinemanufacturerthatholdsaclass“A”winepermitshallbedeemedtohaveconsentedtothejurisdictionofthedepartmentoranyotheragencyorcourtinthisstateconcerningenforcementofthischapterandanyrelatedlaws,rules,orregulations.Apermitholdershallallowthedepartmenttoperformanauditofmanufacturingandsalesrecordsuponrequest.7.Aviolationofthissectionshallsubjectthepermitholdertothegeneralpenaltiesprovidedinthischapterandshallconstitutegroundsforimpositionofacivilpenaltyorsuspensionorrevocationofthepermitpursuanttosection123.39.Sec.10.Section123.177,subsection2,Code2026,isamendedtoreadasfollows:2.Aclass“A”winepermitholdermaypurchaseandresellonlythosebrandsofwinebroughtintothestatewhicharemanufactured,fermented,bottled,shipped,orimportedbyapersonholdingacertificateofcomplianceissuedpursuanttosection123.180.Sec.11.Section123.179,Code2026,isamendedtoreadasfollows:123.179Winepermitandlicensefees.1.Theannualpermitfeeforaclass“A”winepermitthatisnotissuedtoanativewinemanufacturerissevenhundredfiftydollars,excepttheannualpermitfeeforaclass“A”winepermitissuedtoanativewinemanufacturerasprovidedinsection123.176oranonnativewinemanufacturerasprovidedinsection123.176Aisonehundreddollars.2.Theannualpermitfeeforaclass“A”winepermitissuedtoanativewinemanufacturerisonehundreddollars.3.2.Thefeeforacharitybeer,spirits,andwinespecialeventlicenseisonehundreddollars.HouseFile2780,p.64.3.Thefeeforawineauctionpermitisonehundreddollars.Sec.12.Section123.180,subsections1,2,and3,Code2026,areamendedtoreadasfollows:1.Amanufacturer,vintner,bottler,importer,orvendorofwine,oranagentthereof,desiringtoship,sell,orhavewinebroughtintothisstateforsaleatwholesaleresalebyaclass“A”winepermitteeshallfirstmakeapplicationforandshallbeissuedavintner’scertificateofcompliancebythedirectorforthatpurpose.Thevintner’scertificateofcomplianceshallexpireattheendofoneyearfromthedateofissuanceandshallberenewedforalikeperioduponapplicationtothedirectorunlessotherwiserevokedforcause.Eachcompletedapplicationforavintner’scertificateofcomplianceorrenewalofacertificateshallbesubmittedelectronically,orinamannerprescribedbythedirector,andshallbeaccompaniedbyafeeoftwohundreddollarspayabletothedepartment.Eachholderofavintner’scertificateofcomplianceshallfurnishtheinformationrequiredbythedirectorintheformthedirectorrequires.AvintnerorwinebottlerwhoseplantislocatedinIowaandwhootherwiseholdsaclass“A”winepermittosellwineatwholesaleisexemptfromthefee,butnottheothertermsandconditions.Theholderofavintner’scertificateofcompliancemayalsoholdaclass“A”winepermit.2.Atthetimeofapplyingforavintner’scertificateofcompliance,eachapplicantshallfilewiththedepartmentelectronically,orinamannerprescribedbythedirector,alistofallclass“A”winepermitteeswithwhomitintendstodobusiness.Thelistingofclass“A”winepermitteesasfiledwiththedepartmentshallbeamendedbytheholderofthecertificateofcomplianceasnecessarytokeepthelistingcurrentwiththedepartment.3.a.Exceptasprovidedinparagraph“b”,allclass“A”winepermitholdersshallsellonlythosebrandsofwinebroughtintothestatewhicharemanufactured,bottled,fermented,shi
