DAVIS, MERSKI, BRENNAN, HOWARD, STEELE, DELLOSO, FREEMAN,CEPEDA-FREYTIZ, INGLIS, CIRESI, SMITH-WADE-EL AND CURRY,APRIL 8, 2026REFERRED TO COMMITTEE ON HOUSING AND COMMUNITY DEVELOPMENT,APRIL 8, 2026AN ACT1 Amending the act of February 9, 1999 (P.L.1, No.1), entitled "An2 act providing for borrowing for capital facilities;3 conferring powers and duties on various administrative4 agencies and officers; making appropriations; and making5 repeals," in capital facilities, further providing for6 definitions and repealing provisions relating to7 appropriation for and limitation on redevelopment assistance8 capital projects.9 The General Assembly of the Commonwealth of Pennsylvania10 hereby enacts as follows:11 Section 1. The definition of "redevelopment assistance12 capital project" in section 302 of the act of February 9, 199913 (P.L.1, No.1), known as the Capital Facilities Debt Enabling14 Act, is amended to read:15 Section 302. Definitions.16 The following words and phrases when used in this chapter17 shall have the meanings given to them in this section unless the18 context clearly indicates otherwise:19 * * *1 "Redevelopment assistance capital project." The design and2 construction of a project which meets all of the following:3(1) Is a project, including infrastructure associated4 with the project. A project does not include highways,5 bridges, waste disposal facilities, sewage facilities or6 water facilities. This paragraph includes:7(i) Storm water, water or sewer infrastructure, or8tunnels, bridges or roads, when associated with a project9that is part of an economic development project.10(ii) Hospital facilities and capital improvements11for hospital facilities.12(2) Is a project which will generate substantial13 increases in or maintain current levels of employment, tax14 revenues or other measures of economic activity. This15 paragraph includes:16(i) [a] A community asset project[; and].17(ii) [a] A housing project [that will support and18generate economic activity].19(3) Is a project that has a regional or20 multijurisdictional impact [or, in the case of housing, is21 part of a community revitalization plan].22(4) Is eligible for tax-exempt bond funding under23 existing Federal law and regulations.24(5) Has at least a 50% non-State financial participation25 documented at the time of application, including a portion of26 any funds reserved for future physical maintenance and27 operation of the project:28(i) at least half of which is secured funding;29(ii) toward which the only noncash non-State30financial participation permitted is land or fixed assets20260HB2367PN3148 - 2 -1which have a substantial useful life and are directly2related to the project;3(iii) toward which State funds from other programs4may not be used; and5(iv) toward which funds from Federal sources may be6used.7(6) Has a total project cost of at least $1,000,000.8(7) (Reserved).9 * * *10 Section 2. Section 317(c) of the act is repealed:11 Section 317. Appropriation for and limitation on redevelopment12assistance capital projects.13 * * *14 [(c) Housing units.--An amount not to exceed $50,000,000 of15 the amount under subsection (b) may be used for the construction16 of housing units.]17 Section 3.
