34 AUTHORITY DIVISION - TRANSFER OF FUNDS.        Building Authority Division is
35 hereby authorized, after seeking the approval of the Chief Fiscal Officer of
36 the State and the Arkansas Legislative Council or Joint Budget Committee to

1 request transfer from the appropriation made in the Building Maintenance
2 Section for Building Maintenance to the Acquisition and Maintenance
3 appropriation in the Acquisition and Maintenance Section and to receive from
4 another state agency that seeks like approvals its authority, appropriation
5 and the transfer of funds to be deposited into the Building Authority
6 Division Real Estate Fund to become part of the Acquisition and Maintenance
7 appropriation, and to be used for any purposes as set forth by law for said
8 Real Estate Fund.
9   Determining the maximum number of employees and the maximum amount of
10 appropriation and general revenue funding for a state agency each fiscal year
11 is the prerogative of the General Assembly.      This is usually accomplished by
12 delineating such maximums in the appropriation act(s) for a state agency and
13 the general revenue allocations authorized for each fund and fund account by
14 amendment to the Revenue Stabilization law.      Further, the General Assembly
15 has determined that Building Authority Division may operate more efficiently
16 if some flexibility is provided to Building Authority Division authorizing
17 broad powers under this section.    Therefore, it is both necessary and
18 appropriate that the General Assembly maintain oversight by requiring prior
19 approval of the Legislative Council or Joint Budget Committee as provided by
20 this section.   The requirement of approval by the Legislative Council or
21 Joint Budget Committee is not a severable part of this section.      If the
22 requirement of approval by the Legislative Council or Joint Budget Committee
23 is ruled unconstitutional by a court of competent jurisdiction, this entire
24 section is void.
25   The provisions of this section shall be in effect only from July 1, 2025
26 2026 through June 30, 2026 2027.

28      SECTION 34. SPECIAL LANGUAGE.       NOT TO BE INCORPORATED INTO THE ARKANSAS
29 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.      BUILDING
30 AUTHORITY DIVISION CONTINGENCY APPROPRIATION TRANSFER AUTHORITY.      Building

2      SECTION 35. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS

4 AUTHORITY DIVISION - TRANSFER TO FACILITIES MANAGEMENT CONTINGENCY
5 APPROPRIATION AUTHORITY. (a) In order to provide a more cost effective method
6 to address the emerging infrastructure needs of Arkansas State Government,
7 appropriations and funds transferred to the Facilities Management Contingency
8 Appropriation are to be used in the event that the Building Authority
9 Division executes one or more building contracts or maintenance agreements
10 with State Agencies, and the appropriations or funds otherwise provided for
11 the Building Authority Division are not sufficient to address those needs,
12 and it is more cost effective for Building Authority Division to execute
13 these services.    Any State Agency may transfer or deposit funds and
14 appropriations to Building Authority Division - Facilities Management
15 Contingency Appropriation authorized in the Building Maintenance Section of
16 this Act to execute one or more building contracts or maintenance agreements
17 with said State Agencies.     Building Authority Division shall provide
18 justification to the Chief Fiscal Officer of the State for the need of such
19 appropriations and funds transfers and seek and receive approval of the Chief
20 Fiscal Officer of the State. Building Authority Division shall then seek and
21 receive the approval of the Arkansas Legislative Council or Joint Budget
22 Committee.   The requirement of approval by the Arkansas Legislative Council
23 or Joint Budget Committee is not a severable part of the section.       If the
24 requirement of approval by the Arkansas Legislative Council or Joint Budget
25 Committee is ruled unconstitutional by a court of competent jurisdiction,
26 this entire section is void.
27   (b) The Chief Fiscal Officer of the State shall make the necessary
28 adjustments on his or her books and the books of the Auditor of the State for
29 the transfer or deposit of the funds and appropriations from each State
30 Agency to the appropriation authorized in the Building Maintenance Section of
31 this Act and to the various Building Authority Division accounts to be used
32 exclusively by Building Authority Division for the fiscal year.
33   The provisions of this section shall be in effect only from July 1, 2025
34 2026 through June 30, 2026 2027.

2 BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - TRANSFER.
3 In the event there is not sufficient appropriation and/or funding provided
4 for by the General Assembly for any state agency, board or commission to
5 participate in the Sustainable Building Design Program for renovations of
6 state owned property which exceeds two hundred fifty thousand dollars
7 ($250,000), the agency may request a transfer from the Sustainable Building
8 Design Program appropriation authorized in the Sustainable Building Design
9 Program Section of this Act from the Chief Fiscal Officer of the State. The
10 request shall clearly state the amount required and such other information as
11 may be required by the Chief Fiscal Officer of the State necessary to make a
12 decision regarding the request. Upon approval of the Chief Fiscal Officer of
13 the State and prior review by the Arkansas Legislative Council or Joint
14 Budget Committee, the State Auditor shall be notified as of the amount and
15 the purposes for which the appropriation and/or funding is to be transferred
16 and shall be established upon the books of the Department of Finance and
17 Administration and the State Auditor.        If desired, the appropriation may be
18 supplemental to those regularly appropriated for like purposes by the General
19 Assembly for that agency.
20   Provided further, that all state agencies, boards or commissions shall
21 have prior approval by the Building Authority Division as authorized for the
22 Sustainable Building Design Program in accordance with established Rules and
23 Regulations.
24   The provisions of this section shall be in effect only from July 1, 2025
25 2026 through June 30, 2026 2027.

27      SECTION 37. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS

29 BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - REVOLVING
30 LOAN FUND.     The Sustainable Building Design Program Appropriation is intended
31 to provide additional appropriation authority for the Sustainable Building
32 Design Program.     Funding for the program may be made available by the Chief
33 Fiscal Officer of the State, in the form of a loan, from a transfer from the
34 Sustainable Building Design Revolving Loan Fund after the required review by
35 the Arkansas Legislative Council or Joint Budget Committee, approval by the
36 Chief Fiscal Officer of the State and approval through rules established and

1 administered by Building Authority Division.      Moneys made available for the
2 repayment of a loan shall be deposited to the credit of the Sustainable
3 Building Design Revolving Loan Fund as a “Refund to Expenditure” for the year
4 in which the deposit is made. In the event that the funds for the repayment
5 of a loan are held in depositories other than the State Treasury, the
6 administrative head of the affected state agency shall issue a check drawn
7 against the funds, which shall be deposited in the Sustainable Building
8 Design Revolving Loan Fund.
9      The provisions of this section shall be in effect only from July 1, 2025
10 2026 through June 30, 2026 2027.

12SECTION 38. SPECIAL LANGUAGE.     NOT TO BE INCORPORATED INTO THE ARKANSAS
13 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  BUILDING
14 AUTHORITY DIVISION - FUNDING TRANSFER - CASH FUND ACCOUNT.      Building
15 Authority Division is authorized to transfer any unspent funds remaining in
16 any cash fund account established for the management of a state owned
17 facility managed by, but not owned by, Building Authority Division to the
18 Building Authority Maintenance Fund to support the facility’s Maintenance and
19 Operations appropriations.
20      The provisions of this section shall be in effect only from July 1, 2025
21 2026 through June 30, 2026 2027.

23SECTION 39. SPECIAL LANGUAGE.     NOT TO BE INCORPORATED INTO THE ARKANSAS
24 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  OFFICE OF
25 STATE TECHNOLOGY - COMPLIANCE WITH STATE AND FEDERAL REGULATIONS.
26 1.   In order to effect compliance with the requirements of state and federal
27 statutory and regulatory provisions, the Director shall adjust billing rates
28 or issue billing adjustments to be federally compliant, notwithstanding the
29 provisions of ACA §25-4-105 and §25-4-119 or funds sufficient to effect
30 compliance shall be provided the Division from General Revenues, Special
31 Revenues or such other fund sources as may become available.      These actions
32 shall be subject to the approval of the Chief Fiscal Officer of the State and
33 approval by the Arkansas Legislative Council or Joint Budget Committee.
34 2.   The Director shall have authority to transfer funds between the
35 Information Technology Reserve Fund established by ACA §25-4-123 and the
36 Division of Information Systems Revolving Fund established by ACA §25-4-121

1 for cash management purposes.
2   Determining the maximum number of employees and the maximum amount of
3 appropriation and general revenue funding for a state agency each fiscal year
4 is the prerogative of the General Assembly.      This is usually accomplished by
5 delineating such maximums in the appropriation act(s) for a state agency and
6 the general revenue allocations authorized for each fund and fund account by
7 amendment to the Revenue Stabilization law.      Further, the General Assembly
8 has determined that the Office of State Technology may operate more
9 efficiently if some flexibility is provided to the Office of State Technology
10 authorizing broad powers under this section.      Therefore, it is both necessary
11 and appropriate that the General Assembly maintain oversight by requiring
12 prior approval of the Legislative Council or Joint Budget Committee as
13 provided by this section.   The requirement of approval by the Legislative
14 Council or Joint Budget Committee is not a severable part of this section.
15 If the requirement of approval by the Legislative Council or Joint Budget
16 Committee is ruled unconstitutional by a court of competent jurisdiction,
17 this entire section is void.
18   The provisions of this section shall be in effect only from July 1, 2025
19 2026 through June 30, 2026 2027.

21      SECTION 40. SPECIAL LANGUAGE.       NOT TO BE INCORPORATED INTO THE ARKANSAS
22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.      TRANSFER
23 PROVISION - LINE ITEMS - OFFICE OF STATE TECHNOLOGY - OPERATIONS.      After
24 receiving approval from the Chief Fiscal Officer of the State and prior
25 review by the Arkansas Legislative Council or Joint Budget Committee, the
26 Secretary of the Department of Transformation and Shared Services is
27 authorized to transfer appropriation between the line items authorized herein
28 for the Office of State Technology - Operations to best utilize resources to
29 respond to the needs of the Division's customers.
30   The provisions of this section shall be in effect only from July 1, 2025
31 2026 through June 30, 2026 2027.

33      SECTION 41. SPECIAL LANGUAGE.       NOT TO BE INCORPORATED INTO THE ARKANSAS
34 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.      ARKANSAS
35 GEOGRAPHIC INFORMATION SYSTEMS OFFICE - TRANSFER OF CARRY FORWARD.      Any
36 unexpended balance of funds remaining on June 30 of each fiscal year in the

1 Miscellaneous Agencies Fund Account for the Arkansas Geographic Information
2 System's Office, shall be transferred to the Geographic Information Systems
3 Fund to be used for operating and maintaining the Arkansas Spatial Data
4 Infrastructure, creating, updating, maintaining and disseminating framework
5 spatial data as defined by Arkansas Code §15-21-502.
6 (1)   Prior to June 30, 2026 2027 the Agency shall by written statement set
7 forth its reason(s) for the need to carry forward said funding to the
8 Department of Finance and Administration Office of Budget;
9 (2)   The Department of Finance and Administration Office of Budget shall
10 report to the Arkansas Legislative Council all amounts carried forward by the
11 September Arkansas Legislative Council or Joint Budget Committee meeting
12 which report shall include the name of the Agency, Board, Commission or
13 Institution and the amount of the funding carried forward, the program name
14 or line item, the funding source of the appropriation and a copy of the
15 written request set forth in (1) above;
16 (3)   Each Agency, Board, Commission or Institution shall provide a written
17 report to the Arkansas Legislative Council or Joint Budget Committee
18 containing all information set forth in item (2) above, along with a written
19 statement as to the current status of the project, contract, purpose, etc.
20 for which the carry forward was originally requested no later than thirty
21 (30) days prior to the time the Agency, Board, Commission or Institution
22 presents its budget request to the Arkansas Legislative Council or Joint
23 Budget Committee; and
24 (4)   Thereupon, the Department of Finance and Administration shall include
25 all information obtained in item (3) above in the biennial budget manuals
26 and/or a statement of non-compliance by the Agency, Board, Commission or
27 Institution.
28The provisions of this section shall be in effect only from July 1,
29 2025 2026 through June 30, 2026 2027.

31SECTION 42. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
33 CENTRALIZED SERVICES. (a) The Department of Shared Administrative Services
34 may enter into contracts with a state agency or governmental entity as
35 necessary for the centralization of governmental services.
36(b) The department may establish fair and reasonable rates or fee

1 schedules to be assessed to a state agency or governmental entity receiving
2 services for the purpose of recovering allowable costs associated with
3 providing the services.
4      (c) The rate or fee schedule under subsection (b) of this section shall
5 apply uniformly to all state agencies or governmental entities receiving
6 substantially similar services.
7      (d) The authority provided in this section is limited to the:
8(1) Office of State Procurement;
9(2) Office of Personnel Management; and
10(3) Fleet Management Program within the Department of Shared
11 Administrative Services.
12      (e) The entities in subdivisions (d)(1)-(3) of this section may
13 establish estimated billing rates to be developed for a period of time to
14 coincide with the state budgeting process.
15      (f) The department may adjust billing as necessary to ensure compliance
16 with applicable:
17(1) State laws;
18(2) Federal laws; and
19(3) State rules and federal regulations.
20      (g) Billing adjustments under subsection (f) of this section are
21 subject to the approval of the Chief Fiscal Officer of the State.
22      (h) The provisions of this section shall be in effect only from July 1,
23 2026 through June 30, 2027.

25      SECTION 43. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 25-36-
26 104(c) and (d), concerning data recording and tracking under the Arkansas
27 Economic Opportunity Expansion Act, are amended to read as follows:
28      (c)(1) Each state agency shall include in its budget report to the
29 Joint Budget Committee a list of all contracts in amounts exceeding fifty
30 thousand dollars ($50,000) awarded to minority-owned businesses.
31(2) The vice president or vice chancellor for finance of each state
32 college and university shall include in his or her budget report to the Joint
33 Budget Committee a listing of all contracts in amounts exceeding fifty
34 thousand ($50,000) awarded to minority-owned businesses.
35 (d) The director shall promulgate rules necessary for the implementation of
36 this chapter.

2SECTION 44.       SPECIAL LANGUAGE — CODE AMENDMENT.   Arkansas Code § 19-61-
3 801(6)(A), concerning the definitions used regarding intergovernmental
4 relations under the Arkansas Procurement Law, is amended to read as follows:
5(6)(A)    “Public school Local government construction services”
6 means services procured by a municipality, public school district, or open-
7 enrollment public charter school under a contract with a corresponding
8 cooperative purchasing verification letter providing for the making of
9 repairs, alterations, erection, or other permanent improvements to a public
10 building, property, or structure that do not exceed a total aggregate amount
11 of one million dollars ($1,000,000) for a public procurement unit in a fiscal
12 year.

14SECTION 45.       SPECIAL LANGUAGE — CODE AMENDMENT.   Arkansas Code § 19-61-
15 802(a)(1), concerning cooperative purchasing under the Arkansas Procurement
16 Law, is amended to read as follows:
17(a)(1)     A public procurement unit may participate in, sponsor, conduct,
18 or administer a cooperative purchasing agreement for the acquisition of
19 public school local government construction services, commodities, or other
20 services in accordance with an agreement entered into between the
21 participants.
22
23SECTION 46.       SPECIAL LANGUAGE — CODE AMENDMENT.   Arkansas Code § 19-61-
24 802(a)(2)(A), concerning cooperative purchasing under the Arkansas
25 Procurement Law, is amended to read as follows:
26(2)(A)    A cooperative purchasing agreement is limited to public
27 school local government construction services, commodities, and other
28 services for which the public procurement unit may realize savings or
29 material economic value, or both.

31SECTION 47.       SPECIAL LANGUAGE — CODE AMENDMENT.   Arkansas Code § 19-61-
32 802(b)(2), concerning cooperative purchasing under the Arkansas Procurement
33 Law, is amended to read as follows:
34(2)    The reports required under this subsection shall be
35 submitted by October 1 in the format required by the Legislative Council and
36 shall include the following:

1(A)   The name of the contractor;
2(B)   The name of the procuring agency;
3(C)   The contact information for the contractor and
4 procuring agency;
5(D)   The total cost of the contract, including all

7(E)   A description of the public school local government
8 construction services, goods, or other services procured; and
9(F)   Any other information requested by the Legislative
10 Council or the Joint Budget Committee.

12      SECTION 48.     SPECIAL LANGUAGE — CODE AMENDMENT.    Arkansas Code § 19-61-
13 802(d), concerning cooperative purchasing under the Arkansas Procurement Law,
14 is amended to read as follows:
15      (d)   If a public procurement unit needs to procure public school local
16 government construction services in excess of the amount provided in § 19-61-
17 801(6), the public procurement unit may submit a request for a waiver to the
18 Executive Subcommittee of the Legislative Council.
19
20      SECTION 49. COMPLIANCE WITH OTHER LAWS.      Disbursement of funds
21 authorized by this act shall be limited to the appropriation for such agency
22 and funds made available by law for the support of such appropriations; and
23 the restrictions of the State Procurement Law, the General Accounting and
24 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
25 Procedures and Restrictions Act, or their successors, and other fiscal
26 control laws of this State, where applicable, and regulations promulgated by
27 the Department of Finance and Administration, as authorized by law, shall be
28 strictly complied with in disbursement of said funds.

30      SECTION 50. LEGISLATIVE INTENT.      It is the intent of the General
31 Assembly that any funds disbursed under the authority of the appropriations
32 contained in this act shall be in compliance with the stated reasons for
33 which this act was adopted, as evidenced by the Agency Requests, Executive
34 Recommendations and Legislative Recommendations contained in the budget
35 manuals prepared by the Department of Finance and Administration, letters, or
36 summarized oral testimony in the official minutes of the Arkansas Legislative

1 Council or Joint Budget Committee which relate to its passage and adoption.

3      SECTION 51. EMERGENCY CLAUSE.       It is found and determined by the
4 General Assembly, that the Constitution of the State of Arkansas prohibits
5 the appropriation of funds for more than a one (1) year period; that the
6 effectiveness of this Act on July 1, 2026 is essential to the operation of
7 the agency for which the appropriations in this Act are provided, and that in
8 the event of an extension of the legislative session, the delay in the
9 effective date of this Act beyond July 1, 2026 could work irreparable harm
10 upon the proper administration and provision of essential governmental
11 programs. Therefore, an emergency is hereby declared to exist and this Act
12 being necessary for the immediate preservation of the public peace, health
13 and safety shall be in full force and effect from and after July 1, 2026.
