(a) In order to provide a more cost effective method6 to address the emerging infrastructure needs of Arkansas State Government,7 appropriations and funds transferred to the Facilities Management Contingency8 Appropriation are to be used in the event that the Building Authority9 Division executes one or more building contracts or maintenance agreements10 with State Agencies, and the appropriations or funds otherwise provided for11 the Building Authority Division are not sufficient to address those needs,12 and it is more cost effective for Building Authority Division to execute13 these services. Any State Agency may transfer or deposit funds and14 appropriations to Building Authority Division - Facilities Management15 Contingency Appropriation authorized in the Building Maintenance Section of16 this Act to execute one or more building contracts or maintenance agreements17 with said State Agencies. Building Authority Division shall provide18 justification to the Chief Fiscal Officer of the State for the need of such19 appropriations and funds transfers and seek and receive approval of the Chief20 Fiscal Officer of the State. Building Authority Division shall then seek and21 receive the approval of the Arkansas Legislative Council or Joint Budget22 Committee. The requirement of approval by the Arkansas Legislative Council23 or Joint Budget Committee is not a severable part of the section. The10 request shall clearly state the amount required and such other information as11 may be required by the Chief Fiscal Officer of the State necessary to make a12 decision regarding the request. Upon approval of the Chief Fiscal Officer of13 the State and prior review by the Arkansas Legislative Council or Joint14 Budget Committee, the State Auditor shall be notified as of the amount and15 the purposes for which the appropriation and/or funding is to be transferred16 and shall be established upon the books of the Department of Finance and17 Administration and the State Auditor. If desired, the appropriation may be18 supplemental to those regularly appropriated for like purposes by the General19 Assembly for that agency.20 Provided further, that all state agencies, boards or commissions shall21 have prior approval by the Building Authority Division as authorized for the22 Sustainable Building Design Program in accordance with established Rules and23 Regulations.24 The provisions of this section shall be in effect only from July 1, 202525 2026 through June 30, 2026 2027.2627 SECTION 37. Funding for the program may be made available by the Chief33 Fiscal Officer of the State, in the form of a loan, from a transfer from the34 Sustainable Building Design Revolving Loan Fund after the required review by35 the Arkansas Legislative Council or Joint Budget Committee, approval by the36 Chief Fiscal Officer of the State and approval through rules established and2104-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31 administered by Building Authority Division. Moneys made available for the2 repayment of a loan shall be deposited to the credit of the Sustainable3 Building Design Revolving Loan Fund as a “Refund to Expenditure” for the year4 in which the deposit is made. In the event that the funds for the repayment5 of a loan are held in depositories other than the State Treasury, the6 administrative head of the affected state agency shall issue a check drawn7 against the funds, which shall be deposited in the Sustainable Building8 Design Revolving Loan Fund.9 The provisions of this section shall be in effect only from July 1, 202510 2026 through June 30, 2026 2027.1112SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS13 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BUILDING14 AUTHORITY DIVISION - FUNDING TRANSFER - CASH FUND ACCOUNT. Building15 Authority Division is authorized to transfer any unspent funds remaining in16 any cash fund account established for the management of a state owned17 facility managed by, but not owned by, Building Authority Division to the18 Building Authority Maintenance Fund to support the facility’s Maintenance and19 Operations appropriations.20 The provisions of this section shall be in effect only from July 1, 202521 2026 through June 30, 2026 2027.2223SECTION 39. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS24 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. OFFICE OF25 STATE TECHNOLOGY - COMPLIANCE WITH STATE AND FEDERAL REGULATIONS.26 1. In order to effect compliance with the requirements of state and federal27 statutory and regulatory provisions, the Director shall adjust billing rates28 or issue billing adjustments to be federally compliant, notwithstanding the29 provisions of ACA §25-4-105 and §25-4-119 or funds sufficient to effect30 compliance shall be provided the Division from General Revenues, Special31 Revenues or such other fund sources as may become available. These actions32 shall be subject to the approval of the Chief Fiscal Officer of the State and33 approval by the Arkansas Legislative Council or Joint Budget Committee.34 2. The Director shall have authority to transfer funds between the35 Information Technology Reserve Fund established by ACA §25-4-123 and the36 Division of Information Systems Revolving Fund established by ACA §25-4-1212204-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31 for cash management purposes.2 Determining the maximum number of employees and the maximum amount of3 appropriation and general revenue funding for a state agency each fiscal year4 is the prerogative of the General Assembly. This is usually accomplished by5 delineating such maximums in the appropriation act(s) for a state agency and6 the general revenue allocations authorized for each fund and fund account by7 amendment to the Revenue Stabilization law. Further, the General Assembly8 has determined that the Office of State Technology may operate more9 efficiently if some flexibility is provided to the Office of State Technology10 authorizing broad powers under this section. Therefore, it is both necessary11 and appropriate that the General Assembly maintain oversight by requiring12 prior approval of the Legislative Council or Joint Budget Committee as13 provided by this section. The requirement of approval by the Legislative14 Council or Joint Budget Committee is not a severable part of this section.15 If the requirement of approval by the Legislative Council or Joint Budget16 Committee is ruled unconstitutional by a court of competent jurisdiction,17 this entire section is void.18 The provisions of this section shall be in effect only from July 1, 202519 2026 through June 30, 2026 2027.2021 SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER23 PROVISION - LINE ITEMS - OFFICE OF STATE TECHNOLOGY - OPERATIONS. After24 receiving approval from the Chief Fiscal Officer of the State and prior25 review by the Arkansas Legislative Council or Joint Budget Committee, the26 Secretary of the Department of Transformation and Shared Services is27 authorized to transfer appropriation between the line items authorized herein28 for the Office of State Technology - Operations to best utilize resources to29 respond to the needs of the Division's customers.30 The provisions of this section shall be in effect only from July 1, 202531 2026 through June 30, 2026 2027.3233 SECTION 41. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS34 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS35 GEOGRAPHIC INFORMATION SYSTEMS OFFICE - TRANSFER OF CARRY FORWARD. Any36 unexpended balance of funds remaining on June 30 of each fiscal year in the2304-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31 Miscellaneous Agencies Fund Account for the Arkansas Geographic Information2 System's Office, shall be transferred to the Geographic Information Systems3 Fund to be used for operating and maintaining the Arkansas Spatial Data4 Infrastructure, creating, updating, maintaining and disseminating framework5 spatial data as defined by Arkansas Code §15-21-502.6 (1) Prior to June 30, 2026 2027 the Agency shall by written statement set7 forth its reason(s) for the need to carry forward said funding to the8 Department of Finance and Administration Office of Budget;9 (2) The Department of Finance and Administration Office of Budget shall10 report to the Arkansas Legislative Council all amounts carried forward by the11 September Arkansas Legislative Council or Joint Budget Committee meeting12 which report shall include the name of the Agency, Board, Commission or13 Institution and the amount of the funding carried forward, the program name14 or line item, the funding source of the appropriation and a copy of the15 written request set forth in (1) above;16 (3) Each Agency, Board, Commission or Institution shall provide a written17 report to the Arkansas Legislative Council or Joint Budget Committee18 containing all information set forth in item (2) above, along with a written19 statement as to the current status of the project, contract, purpose, etc.20 for which the carry forward was originally requested no later than thirty21 (30) days prior to the time the Agency, Board, Commission or Institution22 presents its budget request to the Arkansas Legislative Council or Joint23 Budget Committee; and24 (4) Thereupon, the Department of Finance and Administration shall include25 all information obtained in item (3) above in the biennial budget manuals26 and/or a statement of non-compliance by the Agency, Board, Commission or27 Institution.28The provisions of this section shall be in effect only from July 1,29 2025 2026 through June 30, 2026 2027.3031SECTION 42. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.33 CENTRALIZED SERVICES. (a) The Department of Shared Administrative Services34 may enter into contracts with a state agency or governmental entity as35 necessary for the centralization of governmental services.36(b) The department may establish fair and reasonable rates or fee2404-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31 schedules to be assessed to a state agency or governmental entity receiving2 services for the purpose of recovering allowable costs associated with3 providing the services.4 (c) The rate or fee schedule under subsection (b) of this section shall5 apply uniformly to all state agencies or governmental entities receiving6 substantially similar services.7 (d) The authority provided in this section is limited to the:8(1) Office of State Procurement;9(2) Office of Personnel Management; and10(3) Fleet Management Program within the Department of Shared11 Administrative Services.12 (e) The entities in subdivisions (d)(1)-(3) of this section may13 establish estimated billing rates to be developed for a period of time to14 coincide with the state budgeting process.15 (f) The department may adjust billing as necessary to ensure compliance16 with applicable:17(1) State laws;18(2) Federal laws; and19(3) State rules and federal regulations.20 (g) Billing adjustments under subsection (f) of this section are21 subject to the approval of the Chief Fiscal Officer of the State.22 (h) The provisions of this section shall be in effect only from July 1,23 2026 through June 30, 2027.2425 SECTION 43. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 25-36-26 104(c) and (d), concerning data recording and tracking under the Arkansas27 Economic Opportunity Expansion Act, are amended to read as follows:28 (c)(1) Each state agency shall include in its budget report to the29 Joint Budget Committee a list of all contracts in amounts exceeding fifty30 thousand dollars ($50,000) awarded to minority-owned businesses.31(2) The vice president or vice chancellor for finance of each state32 college and university shall include in his or her budget report to the Joint33 Budget Committee a listing of all contracts in amounts exceeding fifty34 thousand ($50,000) awarded to minority-owned businesses.35 (d) The director shall promulgate rules necessary for the implementation of36 this chapter.2504-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB312SECTION 44. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-3 801(6)(A), concerning the definitions used regarding intergovernmental4 relations under the Arkansas Procurement Law, is amended to read as follows:5(6)(A) “Public school Local government construction services”6 means services procured by a municipality, public school district, or open-7 enrollment public charter school under a contract with a corresponding8 cooperative purchasing verification letter providing for the making of9 repairs, alterations, erection, or other permanent improvements to a public10 building, property, or structure that do not exceed a total aggregate amount11 of one million dollars ($1,000,000) for a public procurement unit in a fiscal12 year.1314SECTION 45. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-15 802(a)(1), concerning cooperative purchasing under the Arkansas Procurement16 Law, is amended to read as follows:17(a)(1) A public procurement unit may participate in, sponsor, conduct,18 or administer a cooperative purchasing agreement for the acquisition of19 public school local government construction services, commodities, or other20 services in accordance with an agreement entered into between the21 participants.2223SECTION 46. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-24 802(a)(2)(A), concerning cooperative purchasing under the Arkansas25 Procurement Law, is amended to read as follows:26(2)(A) A cooperative purchasing agreement is limited to public27 school local government construction services, commodities, and other28 services for which the public procurement unit may realize savings or29 material economic value, or both.3031SECTION 47. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-32 802(b)(2), concerning cooperative purchasing under the Arkansas Procurement33 Law, is amended to read as follows:34(2) The reports required under this subsection shall be35 submitted by October 1 in the format required by the Legislative Council and36 shall include the following:2604-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31(A) The name of the contractor;2(B) The name of the procuring agency;3(C) The contact information for the contractor and4 procuring agency;5(D) The total cost of the contract, including all6 available extensions;7(E) A description of the public school local government8 construction services, goods, or other services procured; and9(F) Any other information requested by the Legislative10 Council or the Joint Budget Committee.1112 SECTION 48. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-13 802(d), concerning cooperative purchasing under the Arkansas Procurement Law,14 is amended to read as follows:15 (d) If a public procurement unit needs to procure public school local16 government construction services in excess of the amount provided in § 19-61-17 801(6), the public procurement unit may submit a request for a waiver to the18 Executive Subcommittee of the Legislative Council.1920 SECTION 49. COMPLIANCE WITH OTHER LAWS. Disbursement of funds21 authorized by this act shall be limited to the appropriation for such agency22 and funds made available by law for the support of such appropriations; and23 the restrictions of the State Procurement Law, the General Accounting and24 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary25 Procedures and Restrictions Act, or their successors, and other fiscal26 control laws of this State, where applicable, and regulations promulgated by27 the Department of Finance and Administration, as authorized by law, shall be28 strictly complied with in disbursement of said funds.2930 SECTION 50. LEGISLATIVE INTENT. It is the intent of the General31 Assembly that any funds disbursed under the authority of the appropriations32 contained in this act shall be in compliance with the stated reasons for33 which this act was adopted, as evidenced by the Agency Requests, Executive34 Recommendations and Legislative Recommendations contained in the budget35 manuals prepared by the Department of Finance and Administration, letters, or36 summarized oral testimony in the official minutes of the Arkansas Legislative2704-27-2026 15:18:23 JAP059As Engrossed: S4/22/26 S4/27/26 SB31 Council or Joint Budget Committee which relate to its passage and adoption.23 SECTION 51. EMERGENCY CLAUSE. It is found and determined by the4 General Assembly, that the Constitution of the State of Arkansas prohibits5 the appropriation of funds for more than a one (1) year period; that the6 effectiveness of this Act on July 1, 2026 is essential to the operation of7 the agency for which the appropriations in this Act are provided, and that in8 the event of an extension of the legislative session, the delay in the9 effective date of this Act beyond July 1, 2026 could work irreparable harm10 upon the proper administration and provision of essential governmental11 programs.
