No. 471203/25/2026 Authored by Schultz and RepinskiThe bill was read for the first time and referred to the Committee on Health Finance and Policy1.1A bill for an act1.2relating to health; authorizing use of private residential pools for certified swimming1.3classes; amending Minnesota Statutes 2024, section 144.1222, subdivision 4, by1.4adding a subdivision.1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:1.6Section 1. Minnesota Statutes 2024, section 144.1222, is amended by adding a subdivision1.7to read:1.8Subd. 2e. Private residential pool used for certified swimming classes. Notwithstanding1.9Minnesota Rules, part 4717.0250, subpart 7, a private residential swimming pool may be1.10used as part of a business if the private residential pool is used by a paying guest of the1.11homeowner and the guest is participating in a certified swimming class conducted by the1.12homeowner, provided that:1.13(1) the homeowner is a certified swimming instructor and is conducting a certified1.14swimming class on a one-on-one basis; and1.15(2) not more than four individuals are in the pool at the same time during the class.1.16Sec. 2. Minnesota Statutes 2024, section 144.1222, subdivision 4, is amended to read:1.17Subd. 4. Definitions. (a) For purposes of this section, the following terms have the1.18meanings given them.1.19(b) "ASME/ANSI standard" means a safety standard accredited by the American National1.20Standards Institute and published by the American Society of Mechanical Engineers.Sec. 2. 103/18/26 REVISOR SGS/DG 26-081242.1 (c) "ASTM standard" means a safety standard issued by ASTM International, formerly2.2 known as the American Society for Testing and Materials.2.3 (d) "Public pool" means any pool other than a private residential pool, that is: (1) open2.4 to the public generally, whether for a fee or free of charge; (2) open exclusively to members2.5 of an organization and their guests; (3) open to residents of a multiunit apartment building,2.6 apartment complex, residential real estate development, or other multifamily residential2.7 area; (4) open to patrons of a hotel or lodging or other public accommodation facility; or2.8 (5) operated by a person in a park, school, licensed child care facility, group home, motel,2.9 camp, resort, club, condominium, manufactured home park, or political subdivision with2.10 the exception of swimming pools at family day care homes licensed under section 142B.41,2.11 subdivision 9, paragraph (a).2.12 (e) "Unblockable suction outlet or drain" means a drain of any size and shape that a2.13 human body cannot sufficiently block to create a suction entrapment hazard and meets2.14 ASME/ANSI standards.2.15 (f) "Certified swimming class" means an infant swimming resource (ISR) class; an2.16 American Red Cross swimming class, swimming lesson, or learn-to-swim class; and any2.17 other swimming class certified by a nationally accredited organization that operates in all2.18 50 states.2.19 (g) "Certified swimming instructor" means a certified ISR instructor; a certified American2.20 Red Cross swimming instructor or swim coach; and any other swim instructor certified by2.21 a nationally accredited organization that operates in all 50 states.Sec. 2. 2
