Section 45-2-120.12, Code of Alabama 1975,17 is amended to read as follows:18"§45-2-120.1219(a)(1) One appointed employee position may be filled by20 the judge of probate which positionThe judge of probate may21 appoint one employee who shall be designatedserve as chief22 clerk.23(2) Two appointed employee positions may be filled by24 the revenue commissioner which positionsThe revenue25 commissioner may appoint two employees who shall be26 designatedserve as chief clerk of collections and chief27 appraiser.28(3) Three appointed employee positions may be filled byPage 1HB606 INTRODUCED29 the sheriff which positionsThe sheriff may appoint three30 employees who shall be designatedserve as chief deputy, chief31 jailer, and chief of the civil division.32(b) The county commission may appoint the following33 shall be appointed contract employees: County administrator,34 emergency management director, juvenile detention director,35 personnel director, building official, clerk/treasurer, county36 engineer, development and environmental director, budget37 director, and communication and information systems director.38(c) Each of the appointed contract employees shall be39 employed under contract with the commission. Each contract40 shall include at a minimum the following provisions:41(1) A provision for termination and severance.42(2) A job description for the position.43(3) An annual written evaluation to be reviewed with44 the employee and retained by the commission in the employee's45 personnel file.46(4) A provision that the contract will be nonbinding on47 the successor commission after each four-year election;48 however, the contracts must be cancelledcanceled or continued49 within 90 days of the successor commission taking office.50(5) A provision that any appointed contract employee51 employed by the county commission may not be subject to any52 action to cancel or not to renew the contract or in any other53 manner dismiss or terminate the contract employee except by a54 three-fourths vote of the elected members of the county55 commission."56Section 2.
