STANLEYDistrict 18 (Middlesex)Co-Sponsored by:Assemblyman VeneziaSYNOPSIS���� Prohibits use and sale of algorithmic devices thatset sale price of goods or services.CURRENT VERSION OF TEXT���� As introduced.��An Act concerning certain algorithmic devices andsupplementing and amending P.L.1970, c.73.���� Be ItEnacted by the Senate and General Assembly ofthe State of New Jersey:���� 1.��� (New section)� a.� Itshall be unlawful for a business entity to use, sell, distribute, develop,transfer, provide access to, or otherwise make available by any means,including through a subscription or the sale of a service, an algorithmicdevice that uses a consumer�s personal data to recommend or set the sale pricefor goods or services.���� b.��� In addition to thepenalties established pursuant to section 7 of P.L.1970, c.73 (C.56:9-7), theAttorney General may file a civil action for a violation of subsection a. ofthis section, for damages, injunctive relief, restitution or return of illegalprofits, civil penalties of up to $1,000 per violation, or some combination ofthese penalties.� The court shall award reasonable attorney�s fees and costs tothe Attorney General if the Attorney General is the prevailing party in thecivil action.���� c.���� The Director of theDivision of Consumer Affairs in the Department of Law and Public Safety shalladopt rules and regulations pursuant to the "Administrative ProcedureAct," P.L.1968, c.410 (C.52:14B-1 et seq.) to effectuate the provisions ofthis act.���� 2.��� Section 2 of P.L.1970,c.73 (C.56:9-2) is amended to read as follows:���� a.� �As used in this act,unless the context otherwise requires , �person� shall mean any naturalperson or persons, or any corporation, partnership, company, trust orassociation of persons.���� b.��� �Trade or commerce�shall include all economic activity involving or relating to any commodity orservice.���� c.���� �Commodity� shall meanany kind of real or personal property.���� d.��� �Service� shall mean anyactivity which is performed in whole or in part for the purpose of financialgain [,] including ,but not limited to , sale, rental, leasing or licensing for use.���� e.���� �Algorithmic device�means a device, such as a software program, that uses one or more algorithms toperform calculations using a consumer�s personal data to recommend or set thesale price for goods or services.���� f.���� �Business entity�means any natural or legal person, business corporation, professional servicescorporation, limited liability company, partnership, limited partnership,business trust, association, or any other legal commercial entity organizedunder the laws of this State or any other state or foreign jurisdiction.����� g.��� �Consumer� means aperson who is a resident of this State acting only in an individual orhousehold context.� �Consumer� shall not include a person acting in acommercial context.���� h.��� �Personal data� meansany information that, regardless of how the information is collected, inferred,or obtained, is linked or reasonably linkable to a specific consumer or consumer�scomputer, mobile telecommunications service device, or any otherInternet-connected device.(cf:� P.L.1970, c.73, s.2)���� 3.��� This act shall takeeffect on the first day of the seventh month next following the date ofenactment, except that the Director of the Division of Consumer Affairs maytake any anticipatory administrative action in advance as shall be necessaryfor the implementation of this act.STATEMENT���� This bill prohibits the useand sale of algorithmic devices that set the sale price of goods or services.���� Specifically, the provisionsof this bill prohibit business entities from using, selling, distributing,developing, transferring, providing access to, or otherwise make available byany means, including through a subscription or the sale of a service, analgorithmic device that uses a consumer�s personal data to recommend or set thesale price for goods or services.���� The bill provides that theAttorney General may file a civil action for a violation for damages,injunctive relief, restitution or return of illegal profits, civil penalties ofup to $1,000 per violation, or some combination of these penalties.� A court isrequired to award reasonable attorney�s fees and costs to the Attorney Generalif the Attorney General is the prevailing party in the civil action.�
