a4532/introduced.txtASSEMBLY, No. 4532STATE OF NEW JERSEY222nd LEGISLATURE�INTRODUCED MARCH 9, 2026Sponsored by:Assemblywoman� MITCHELLE DRULISDistrict 16 (Hunterdon, Mercer, Middlesex and Somerset)Assemblywoman� ANNETTE QUIJANODistrict 20 (Union)Assemblywoman� ROSAURA "ROSY" BAGOLIEDistrict 27 (Essex and Passaic)Co-Sponsored by:Assemblywomen Park, Haider and Assemblyman BhallaSYNOPSIS���� Prohibits sharing automated license plate readerinformation for interstate investigation concerning reproductive health careservices that are legal in NJ.CURRENT VERSION OF TEXT���� As introduced.��An Act concerning the use of automated license plate readersand supplementing Title 2A of the New Jersey Statutes.���� Be ItEnacted by the Senate and General Assembly ofthe State of New Jersey:���� 1.��� a.� As used in this act:���� �Automated license platereader� means an electronic device that photographs or scans the license plateof a motor vehicle and compares the collected data with information containedin any law enforcement database.� The term includes both electronic devicesplaced at a stationary location and mobile devices affixed to a law enforcementvehicle that are capable of operating while the vehicle is in motion.���� �Automated license platereader information� means any information gathered by an automated licenseplate reader or created from the analysis of information obtained by anautomated license plate reader.����� �Law enforcement agency� meansany State, municipal, or county law enforcement agency; a law enforcementagency of an educational institution that appoints law enforcement officerspursuant to P.L.1970, c.211 (C.18A:6-4.2 et seq.); or any other department,division, bureau, commission, board, or other authority of this State orpolitical subdivision thereof which employs law enforcement officers.���� "Out-of-State lawenforcement agency" means any law enforcement agency or officer operatingunder the authority of the laws of another State.����� "Reproductive health careservices" means all medical, surgical, counseling, or referral servicesrelating to the human reproductive system including, but not limited to,services relating to pregnancy, contraception, or termination of a pregnancy.���� �User of an automated licenseplate reader� means any person who operates, manages, or has access toinformation obtained by an automated license plate reader.����� b.��� A user of an automatedlicense plate reader shall not knowingly share, transfer, sell, or permitaccess to automated license plate reader information in furtherance of anyinterstate investigation or proceeding seeking to impose civil or criminalliability on any person for the provision, receipt, or seeking of, or inquiringor responding to an inquiry about, reproductive health care services that arelegal in this State.����� c.���� A law enforcementagency shall not share license plate reader information with any out-of-Statelaw enforcement agency without first obtaining a written declaration from theout-of-State law enforcement agency that automated license plate readerinformation shall not be used in furtherance of any interstate investigation orproceeding seeking to impose civil or criminal liability on any person for theprovision, receipt, or seeking of, or inquiring or responding to an inquiryabout, reproductive health care services that are legal in this State.����� d.��� A user of an automatedlicense plate reader who violates the provisions of subsection b. of thissection shall be liable to a civil penalty of not more than $1,000 for a firstoffense and not more than $5,000 for a second or subsequent offense which may beimposed by the Attorney General and shall be collected in a summary proceedingbefore a court of competent jurisdiction pursuant to the provisions of the�Penalty Enforcement Law of 1999,� P.L.1999, c.274 (C.2A:58-10 et seq.).���� 2.��� This act shall takeeffect immediately.STATEMENT���� This bill prohibits thesharing of automated license plate reader information in furtherance of aninterstate investigation concerning reproductive health care services that arelegal in New Jersey.����� Under the bill, a person whooperates, manages, or has access to information obtained by an automatedlicense plate reader is prohibited from knowingly sharing, transferring,selling, or permitting access to automated license plate reader information in furtheranceof any interstate investigation or proceeding seeking to impose civil orcriminal liability on any person for the provision, receipt, or seeking of, orinquiring or responding to an inquiry about, reproductive health care servicesthat are legal in this State.����� In addition, the billprohibits any law enforcement agency from sharing automated license platereader information with any out-of-State law enforcement agency without firstobtaining a written declaration from the out-of-State law enforcement agencythat the information will not be used in furtherance of any interstateinvestigation or proceeding regarding reproductive health care services.����� Under the bill, any person whooperates, manages, or has access to information obtained by an automatedlicense plate reader who knowingly shares license plate reader information infurtherance of an interstate investigation concerning reproductive health careservices that are legal in this State is liable to a civil penalty of not morethan $1,000 for a first offense and not more than $5,000 for a second orsubsequent offense.���� The bill defines �reproductivehealth care services� as all medical, surgical, counseling, or referralservices relating to the human reproductive system, including but not limitedto services relating to pregnancy, contraception, or termination of a pregnancy.
