hb564/introduced.txt02-13 10:05 H.B. 5641Pollution Standards Amendments2026 GENERAL SESSIONSTATE OF UTAHChief Sponsor: Andrew StoddardSenate Sponsor:23 LONG TITLE4 General Description:5This bill addresses pollution standards for particulate matter and nitrogen oxides.6 Highlighted Provisions:7This bill:8▸ defines terms; and9▸ establishes a total annual emissions limit for PM2.5 and nitrogen oxides from point10 sources in certain counties.11 Money Appropriated in this Bill:12None13 Other Special Clauses:14None15 Utah Code Sections Affected:16 ENACTS:1719-2-109.8, Utah Code Annotated 19531819 Be it enacted by the Legislature of the state of Utah:20Section 1. Section 19-2-109.8 is enacted to read:2119-2-109.8 . Total annual emissions limit -- Particulate matter -- Nitrogen oxides.22 (1) As used in this section:23(a)(i) "Major nonattainment county" means a county:H.B. 56424(A) of the first or second class, as described in Section 17-60-104; and25(B) in a nonattainment area, as that term is defined in 42 U.S.C. Sec. 7501, for26ozone, PM2.5, or nitrogen oxides.27(ii) "Major nonattainment county" includes:28(A) Davis County;29(B) Salt Lake County;30(C) Utah County; andH.B. 564 02-13 10:0531(D) Weber County.32 (b) "PM2.5" means airborne particulate matter approximately 2.5 micrometers or33smaller in diameter.34 (2) The total annual emissions from point sources in major nonattainment counties may not35 exceed:36 (a) 1418 tons of PM2.5 per year; and37 (b) 8870 tons of nitrogen oxides per year.38Section 2. Effective Date.39 This bill takes effect on May 6, 2026.-2-
