SF0107ENROLLED ACT NO. 41, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONAN ACT relating to motor vehicles; creating a motor vehicleregistration and license plate issuance system; requiringthe department of transportation to implement andadminister the system; requiring county treasurers to usethe system; providing definitions; specifying thatdevelopment of the system is part of the replacement of therevenue information system; requiring rulemaking; makingconforming amendments; and providing for effective dates.Be It Enacted by the Legislature of the State of Wyoming:Section 1. W.S. 31-2-236 is created to read:31-2-236. Motor vehicle registration and licenseplate issuance system.(a) As used in this section, "motor vehicleregistration and license plate issuance system" means astatewide electronic motor vehicle registration and licenseplate issuance system implemented and administered by thedepartment that supports all functions necessary toregister motor vehicles and issue license plates under thistitle.(b) The department shall implement and administer amotor vehicle registration and license plate issuancesystem not later than July 1, 2028. The motor vehicleregistration and license plate issuance system shall, at aminimum:(i) Record and process all motor vehicleregistration transactions, including initial registrations,renewals, transfers, corrections, replacements and anyother transactions as authorized by the department;1ORIGINAL SENATE ENGROSSEDFILE NO. SF0107ENROLLED ACT NO. 41, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(ii) Facilitate the issuance, replacement andrenewal of license plates, validation stickers, decals,temporary permits and any other related items as determinedby the department;(iii) Calculate, accept payment for and documentmotor vehicle registration fees under W.S. 31-3-101 and31-3-102;(iv) Calculate, accept payment for and documentspecialty license plate fees and donations related tospecialty license plates;(v) Calculate, accept payment for and documentsales and use taxes pursuant to W.S. 39-15-107(b) or39-16-107(b);(vi) Possess the capacity to exchangeinformation and operate in a manner that is compatible withthe county treasurers' systems to enable thereconciliation, balancing and distribution of all fees andtaxes collected through the system in accordance with thelaw.(c) The department may contract with one (1) or morevendors to develop, implement and provide ongoingadministration of the motor vehicle registration andlicense plate issuance system required under subsection (b)of this section.(d) The department may charge a transaction fee ofnot more than five dollars ($5.00) for each transactionprocessed through the motor vehicle registration andlicense plate issuance system to recover the department'scosts associated with the maintenance and ongoing2ORIGINAL SENATE ENGROSSEDFILE NO. No transaction fee shall becharged under this subsection to the counties. Beforeestablishing a transaction fee or changing an existingtransaction fee under this subsection, the department shallprovide written notice to each county treasurer of theamount of the transaction fee and the date the transactionfee will take effect. No transaction fee charged under thissubsection shall be reduced or deducted from any fees,taxes or distributions owed to other persons under the law.(e) Upon activation of the motor vehicle registrationand license plate issuance system, all county treasurersshall use the system to carry out the county treasurers'duties under this title related to motor vehicleregistration and license plate issuance.Section 2. W.S. 31-1-202(c) and (d) as amended by2025 Wyoming Session Laws Chapter 35, Section 2 andeffective July 1, 2027, is amended to read:31-1-202. Records.(c) Within three (3) business days after issuance ofa vehicle registration or certificate of title, countytreasurers and county clerks shall forward a record thereofto the department. County clerks shall forward a record ofcertificate of title electronically through the electroniclien and title system established under W.S. 31-2-113.County treasurers shall forward records of vehicleregistration electronically through the motor vehicleregistration and license plate issuance system establishedunder W.S. 31-2-236. County treasurers shall notify thedepartment and sheriff of his county of loss or mutilationof license plates.3ORIGINAL SENATE ENGROSSEDFILE NO. SF0107ENROLLED ACT NO. 41, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSION(d) The department shall maintain records of vehicleregistrations in the motor vehicle registration and licenseplate issuance system established under W.S. 31-2-236 fromall counties indexed by distinctive vehicle numbersassigned by the department, the name of the registeredowner and vehicle identification numbers. The departmentshall maintain a record of all vehicle certificates oftitle from all counties in the electronic lien and titlesystem established under W.S. 31-2-113. Records are publicand open to inspection by the public during reasonableoffice hours. The department shall maintain a vehicleidentification number index of all vehicles for whichcertificates of title have been issued. Upon receipt of anotice of issuance of a certificate of title from anycounty clerk the department may destroy all recordsrelating to former transfers of title to the vehicle andshall retain only the notice of issuance of the certificateof title in effect at any time. The department may annuallycompile and publish a list of all registered vehicles andsupplements thereto which shall be furnished to Wyomingpeace officers and the Wyoming office of homeland securitywithout charge.Section 3. The development and implementation of themotor vehicle registration and license plate issuancesystem as required under section 1 of this act shall beconsidered part of the replacement of the revenueinformation system and shall be eligible for funding underW.S. 31-1-204.Section 4.(a) The department of transportation shall promulgateall rules necessary to implement this act.4ORIGINAL SENATE ENGROSSEDFILE NO.
