                                   for
1 AN ACT relating to trade and commerce; requiring direct
2 current     fast    charging      stations  to     display    labels
3 identifying the primary energy resource categories used to
4 supply     electricity    to   the       station;    providing       criminal
5 penalties;    providing     definitions;       and       providing    for   an
6 effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10Section 1.    W.S. 40-32-101 and 40-32-102 are created
11 to read:

240-32-101.     Definitions.

4(a)   As used in this chapter:
5
6(i)     "DC fast   charging station" means       a device
7 used to charge a motor vehicle that meets the definition of
8 "DC Level 1," "DC Level 2" or "DC Level 3" as defined in
9 Standard J1772 of the SAE International standards and any
10 future updates to those standards, or an equivalent power
11 output level;

13(ii)    "Energy    resource    category"     means    coal,
14 natural      gas,      wind,    solar,     hydroelectric,     nuclear,
15 petroleum,     biomass    or    biogas,    geothermal   or   any   other
16 energy resource;

18(iii)    "Public utility" means as defined by W.S.
19 37-1-101(a)(vi).

1(a)   Each    operator       of      a    DC    fast     charging      station
2 operating within this state that receives electricity from
3 a   public   utility       and    not       from      any    other    source       shall
4 display a clear and conspicuous label that is three (3)
5 inches    wide    and     three    (3)      inches      long    on    the     DC    fast
6 charging     station      identifying  the    single     largest      energy
7 resource category provided to the DC fast charging station
8 during the prior calendar year. The single largest energy
9 resource category under this subsection shall be calculated
10 by the public utility providing the electricity to the DC
11 fast     charging       station    and        shall     be    disclosed       to     the
12 operator     of   the     DC    fast    charging        station       based    on    the
13 energy    resource       mix    used     by     the    public    utility       in    the
14 certificated service territory where the DC fast charging
15 station is located.

17(b)   Each    operator       of      a    DC    fast     charging      station
18 operating within this state that generates and uses on-site
19 electricity       and    that     also      receives  electricity      from     a
20 public utility shall display a clear and conspicuous label
21 that is three (3) inches wide and three (3) inches long on
22 the DC fast charging station as follows:

1(i)     If     the       electricity  generated  and      used
2 on-site      constitutes  the     single        largest      energy      resource
3 category used to supply electricity to the DC fast charging
4 station      during    the       prior    calendar        year,     then     the     label
5 shall identify the on-site energy resource category;

7(ii)     If the electricity provided by the public
8 utility      constitutes  the     single        largest      energy      resource
9 category used to supply electricity to the DC fast charging
10 station      during    the       prior    calendar        year,     then     the     label
11 shall identify the single largest energy resource category
12 provided by the public utility. The single largest energy
13 resource category under this paragraph shall be calculated
14 by the public utility providing the electricity to the DC
15 fast     charging      station  and     shall     be     disclosed      to    the
16 operator      of    the    DC    fast     charging        station       based    on   the
17 energy    resource  mix    used    by     the    public      utility      in   the
18 certificated service territory where the DC fast charging
19 station is located.

21(c)    If    the     largest       energy       resource      category        under
22 subsection (a) or (b) of this section constitutes less than
23 fifty     percent      (50%)       of     the     share        of   the    electricity

1 provided to the DC fast charging station during the prior
2 calendar year, then the label shall include the two (2)
3 largest energy resource categories.

5(d)    Upon request, a public utility shall provide to
6 the    operator     of   a   DC   fast  charging     station     the    single
7 largest      energy    resource    category  or    if     applicable   under
8 subsection (c) of this section, the two (2) largest energy
9 resource      categories     as    calculated  based    on   the    energy
10 resource mix used by the public utility in the certificated
11 service territory where the DC fast charging station is
12 located. No public utility shall be required to provide the
13 operator with the largest energy resource categories for
14 each individual meter serving a DC fast charging station.

16(e)    Each operator of a DC fast charging station shall
17 update the label required under subsections (a) and (b) of
18 this section annually but not later than March 31 based on
19 the prior calendar year.

21(f)    Any     operator     of       a    DC   fast       charging      station
22 violating      this      section        is       guilty      of      a   misdemeanor

1 punishable by a fine of not more than seven hundred fifty
2 dollars ($750.00).

4Section 2.   This act is effective July 1, 2026.
