SF0105ENROLLED ACT NO. 37, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONAN ACT relating to real estate brokers and salespersons;amending the definition of "customer" for purposes of realestate transactions and licensing provisions; amending thedisclosures that are required when establishing a brokerrelationship; specifying applicability; and providing foran effective date.Be It Enacted by the Legislature of the State of Wyoming:Section 1. W.S. 33-28-102(b)(xiii) and33-28-306(a)(intro) and (vii) and (b)(i) are amended toread:33-28-102. Definitions.(b) As used in this act:(xiii) "Customer" means a person who hasexpressed an interest in buying, selling or leasing realestate or who attends a showing of real estate without anyagency relationship or a party to a real estate transactionwho has established no intermediary or agency relationshipwith any licensee involved in the transaction;33-28-306. Relationship disclosures.(a) For purposes of this section, open houseshowings, preliminary conversations and requests forfactual information do not constitute discussions orarrangements incidental to a sale, purchase, exchange orlease of real estate. Prior to engaging in any discussionor arrangement incidental to a sale, purchase, exchange orlease of real estate, and, prior to entering into anywritten agreement with a buyer or seller, a licensee shallmake a written disclosure of applicable agency,1ORIGINAL SENATEFILE NO. SF0105ENROLLED ACT NO. 37, SENATESIXTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING2026 BUDGET SESSIONintermediary or customer relationships which that shallcontain, at a minimum, all of the following:(vii) A statement that a customer shall not:(A) Be required to sign any legal writtenagency agreement to view or tour real estate during houseshowings;(B) Be afforded any confidentiality in anycommunication to or with the licensee.(b) The written disclosure shall contain a signatureline for the buyer or seller to acknowledge receipt of thedisclosure. The disclosure and acknowledgment, by itself,shall not constitute a contract or agreement with thelicensee. Until the buyer or seller executes suchacknowledgment, no representation agreement shall beexecuted or valid except, provided if a buyer or sellerrefuses to sign the disclosure after presentation by thelicensee:(i) The licensee may document the refusal with asigned acknowledgement by the licensee and continue withthe transaction or with providing services to a customer;andSection 2. Nothing in this act shall be construed toalter, amend or impair any contract or other agreement forthe establishment of an agency, broker or otherrelationship between a real estate licensee or broker and acustomer, buyer or seller entered into before the effectivedate of this act.2ORIGINAL SENATEFILE NO.
