hb523/introduced.txt02-09 11:05 H.B. 5231Homeless Services Land Use Amendments2026 GENERAL SESSIONSTATE OF UTAHChief Sponsor: Casey SniderSenate Sponsor:23 LONG TITLE4 General Description:5This bill addresses use of funds for a homeless services shelter.6 Highlighted Provisions:7This bill:8▸ defines "large-scale, low-barrier shelter";9▸ repeals eminent domain of unincorporated city owned land;10▸ prohibits the Office of Homeless Services from expending existing or future state11 appropriations to establish a large-scale, low-barrier shelter; and12▸ makes technical and conforming changes.13 Money Appropriated in this Bill:14None15 Other Special Clauses:16None17 Utah Code Sections Affected:18 AMENDS:1935A-16-202 (Effective 05/06/26), as last amended by Laws of Utah 2024, Chapters 338,203492163I-2-263 (Effective 05/06/26), as last amended by Laws of Utah 2025, Chapters 182,22273 and 27723 REPEALS:H.B. 5232463A-5b-807 (Effective 05/06/26) (Repealed 01/01/27), as last amended by Laws of Utah252025, First Special Session, Chapter 172627 Be it enacted by the Legislature of the state of Utah:28Section 1. Section 35A-16-202 is amended to read:2935A-16-202 (Effective 05/06/26). Powers and duties of the office.30 (1) The office shall, under the direction of the coordinator:H.B. 523 02-09 11:0531 (a) assist in providing homeless services in the state;32 (b) coordinate the provision of homeless services in the state;33 (c) manage, with the concurrence of continuum of care organizations approved by the34United States Department of Housing and Urban Development, a Homeless35Management Information System for the state that:36(i) shares client-level data between service providers in the state;37(ii) is effective as a case management system;38(iii) except for individuals receiving services who are victims of domestic violence,39includes an effective authorization protocol for encouraging individuals who are40provided with any homeless services in the state to provide accurate information41to providers for inclusion in the HMIS; and42(iv) meets the requirements of the United States Department of Housing and Urban43Development and other federal requirements;44 (d) in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,45make rules defining "successful exit," "unsuccessful exit," and "neutral exit"; and46 (e) provide support to the steering committee in developing the formula described in47Section 35A-16-211.48 (2) The office may:49 (a) by following the procedures and requirements of Title 63J, Chapter 5, Federal Funds50Procedures Act, seek federal grants, loans, or participation in federal programs; and51 (b) except as provided in Subsection (3), for any federal program that requires the52expenditure of state funds as a condition for participation by the state in a fund,53property, or service, with the governor's approval, expend whatever funds are54necessary out of the [money] funds provided by the Legislature for the use of the55office.56 (3)(a) As used in this Subsection (3):57(i) "Large-scale, low-barrier shelter" means a year-round homeless shelter that58provides 300 or more beds for overnight shelter.59(ii) "Large-scale, low-barrier shelter" does not include a temporary emergency shelter.60 (b) The office may not expend any existing or future funds appropriated by the61Legislature for any purpose relating to the establishment of a large-scale, low-barrier62shelter.63Section 2. Section 63I-2-263 is amended to read:6463I-2-263 (Effective 05/06/26). Repeal dates: Titles 63A through 63O.-2-02-09 11:05 H.B. 52365 (1) Title 63A, Chapter 2, Part 5, Educational Interpretation and Translation Services66Procurement Advisory Council is repealed July 1, 2025.67 [(2) Section 63A-5b-807, Eminent domain of unincorporated city owned land, is repealed68January 1, 2027.]69 [(3)] (2) Section 63A-17-806, Definitions -- Infant at Work Pilot Program -- Administration70-- Report, is repealed June 30, 2026.71 [(4)] (3) Section 63C-1-103, Appointment and terms of boards, committees, councils, and72commissions transitioning on October 1, 2024, or December 31, 2024, is repealed July731, 2025.74 [(5)] (4) Section 63C-1-104, Appointment and terms of boards transitioning on October 1,752024, is repealed January 1, 2025.76 [(6)] (5) Subsection 63G-6a-802(1)(e), regarding a procurement for a presidential debate, is77repealed January 1, 2025.78 [(7)] (6) Subsection 63G-6a-802(3)(b)(iii), regarding a procurement for a presidential79debate, is repealed January 1, 2025.80 [(8)] (7) Subsection 63H-7a-403(2)(b), regarding the charge to maintain the public safety81communications network, is repealed July 1, 2033.82 [(9)] (8) Subsection 63J-1-602.2(30), regarding funding the Enterprise Zone Act, is repealed83December 31, 2026.84 [(10)] (9) Subsection 63J-1-602.2(46), regarding appropriations to the State Tax85Commission for deferral reimbursements, is repealed July 1, 2027.86 [(11)] (10) Section 63M-7-221, Expungement working group, is repealed April 30, 2025.87 [(12)] (11) Title 63N, Chapter 2, Part 2, Enterprise Zone Act, is repealed December 31,882026.89Section 3.
