1 AN ACT concerning higher education; providing that an award of tenure
2   to a faculty member by any postsecondary educational institution shall
3   not create a right or property interest in continued employment with
4   such institution.

6 Be it enacted by the Legislature of the State of Kansas:
7     Section 1. (a) Notwithstanding any other provision of law, an award
8 of tenure to a faculty member by an institution shall not create a right or
9 property interest in continued employment with such institution.
10     (b) As used in this section:
11     (1) "Faculty member" means any unclassified employee of any
12 institution whose primary duties include teaching or research, regardless of
13 rank or title, except employees who are employed under an employment
14 contract;
15     (2) "institution" means any postsecondary educational institution as
16 defined in K.S.A. 74-3201b, and amendments thereto; and
17     (3) "tenure" means a feature of employment that is granted by an
18 institution in recognition of meritorious performance, which is conditioned
19 on future meritorious performance, and may confer special benefits,
20 processes or preferences.
21     (c) The provisions of this section shall apply to any award of tenure
22 to a faculty member by an institution prior to, on or after the effective date
23 of this act.
24     Sec. 2. This act shall take effect and be in force from and after its
25 publication in the Kansas register.
