hb2711/enrolled.txtHOUSE BILL No. 2711AN ACT concerning cities of the third class; relating to procedures required for thedissolution of a city; amending K.S.A. 15-111 and repealing the existing section.Be it enacted by the Legislature of the State of Kansas:Section 1. K.S.A. 15-111 is hereby amended to read as follows:15-111. On the petition of a majority of the legal voters qualifiedelectors of any town or village which became a city of the third class ormay hereafter become a city of the third class by virtue of section oneof the act to which this section is supplementary, it shall be the duty ofthe council of such city, within ten days after the filing of such petition,to order an election by the legal voters of such city, to determine toplace on the next primary or general election ballot, at least 60 daysafter the submission of the petition, the question of whether such cityshall remain a city under the provisions of the act to which this isamendatory, or be dissolved as a corporate body, and remitted to theconditions of being part of the township in which such city shall be islocated.The election shall be conducted like other elections, and the ballotsballot question shall have written or printed thereon be: "For a city," or"Against a city,." and Within three days after the election said ballotsshall be counted by the city council, and the result recorded; and countycanvass has certified the election results, if a two-thirds majority of thelegal votes shall be qualified electors is against the city, then the cityshall thenceforth cease to exist, and the territory embraced within thecity limits shall thenceforth be a part of the township in which saidsuch city was located, and governed in every respect under the generaltownship laws; and. The records of such city shall be delivered to thetownship clerk, and if there be any debts unpaid of such city at the timeit such city ceased to exist under the provisions of this act, then thetownship trustee shall, at the next annual levy of taxes, provide for alevy on the property within the limits of such city, sufficient to pay suchdebt according to its terms in the same manner as taxes are now leviedfor township purposes.Sec. 2. K.S.A. 15-111 is hereby repealed.Sec. 3.
