8A.203,subsection5,section68A.402,subsection308,section68A.404,subsection2,paragraph“c”,orsection3168A.404,subsection5,paragraph“i”,oraninvestigation32undertakenpursuanttoacourtorderissuedfollowinga33complaintsubmittedundersection68B.32B,shall,tothe34greatestextentpossible,shieldtheidentityoflawfuldonors35-3-LSB5420SV(1)91ss/ns3/6S.F.2204toatax-exemptorganization.1b.Agovernmentalentityoremployeeofagovernmental2entityengagedintheinvestigationofaviolationofthis3chaptershallnotcollect,orrequirethesubmissionof,4informationconcerningtheidentityofadonortoatax-exempt5organizationotherthanthosedirectlyrelatedtoaviolation6ofthischapter.7c.Inadditiontothepenaltyprovidedinsection68A.701,8apersonwhoknowinglyorwillfullyviolatesthissection,9section68A.203,subsection5,section68A.402,subsection108,section68A.404,subsection2,paragraph“c”,orsection1168A.404,subsection5,paragraph“i”,shallbesubjecttoa12civilpenaltyoftenthousanddollarsorthreetimestheamount13ofthecontributionorexpenditure,whicheverisgreater,to14becollectedbytheboardanddepositedinthegeneralfundof15thestate.164.Agovernmentalentityoremployeeofagovernmental17entityshallnotdiscloseinformationconcerningtheidentity18ofadonortoatax-exemptorganizationtothepublicor19anothergovernmentalentity,otherthantoanothergovernmental20entitydirectlyinvolvedinaninvestigationdescribedin21subsection3.Thissubsectiondoesnotapplytoinformation22concerningtheidentityofadonorafterafinaldetermination23hasbeenmadethatthedonorviolatedaprovisionofthis24chapter.25EXPLANATION26Theinclusionofthisexplanationdoesnotconstituteagreementwith27theexplanation’ssubstancebythemembersofthegeneralassembly.28Thisbillrelatestocampaignfinance.Thebilldefines29theterms“directlyorindirectly”and“foreignnational”for30purposesofthebillandforindependentcampaignexpenditures31andtransfersofcampaignfundsundercurrentlaw.32Thebillrequiresthetreasurerofapoliticalcommittee33expresslyadvocatingthepassageordefeatofaballot34issuethatreceivesacontributionfromadonortoobtainan35-4-LSB5420SV(1)91ss/ns4/6S.F.2204affirmationthatthedonorisnotaforeignnationalandhas1notknowinglyorwillfullyacceptedfundsinexcessof$100,0002inaggregatefromoneormoreforeignnationalswithinthefour3yearsimmediatelyprecedingthedatethecontributionismade.4Thebillalsorequiresapoliticalcommitteeexpressly5advocatingthepassageordefeatofaballotissuetoinclude6withitsrequiredreportstotheIowaethicsandcampaign7disclosureboardaffirmationsthatthepoliticalcommitteehas8notknowinglyorwillfullyreceived,solicited,oraccepted9contributionsfromaforeignnational,orfromadonorthathas10knowinglyorwillfullyacceptedfundsinexcessof$100,00011inaggregatefromoneormoreforeignnationalswithinthe12fouryearsimmediatelyprecedingthedatethecontributionis13made.Apersonrequiredtofileanindependentexpenditure14reportmustalsoaffirmthatthepersonwillnotknowinglyor15willfullyacceptfundsinexcessof$100,000inaggregatefrom16oneormoreforeignnationalsthroughthedateoftheelection17inwhichtheballotissuewillappearontheballot.18Thebillprohibitsaforeignnationalfromdirectlyor19indirectlyparticipatinginthedecision-makingprocessofa20personregardingtheperson’sactivitiestoinfluenceaballot21issue.Thebillrequiresagovernmentalentityconductingan22investigationrelatedtocertainformsofelectionmisconduct23to,tothegreatestextentpossible,shieldtheidentityof24lawfuldonorstotax-exemptorganizations.Thebillprohibits25agovernmentalentityfromcollectinginformationregardingthe26identityofadonortoatax-exemptorganizationthatisnot27directlyrelatedtoaviolationofCodechapter68A(campaign28finance).Thebillalsoprohibitsagovernmentalentityfrom29disclosinginformationconcerningtheidentityofadonortoa30tax-exemptorganizationtothepublicoranothergovernmental31entity,otherthantoanothergovernmentalentitydirectly32involvedinaninvestigation,unlessafinaldeterminationhas33beenmadethatthedonorviolatedaprovisionofCodechapter3468A.35-5-LSB5420SV(1)91ss/ns5/6S.F.2204Apersonwhoknowinglyorwillfullyviolatesaprovision1ofthebillshallbesubjecttoacivilpenaltyof$10,000or2threetimestheamountofthecontributionorexpenditure,3whicheverisgreater,tobecollectedbytheIowaethics4andcampaigndisclosureboardanddepositedinthegeneral5fundofthestate.Byoperationoflaw,apersonwho6willfullyviolatesaprovisionofthebillisalsoguiltyofa7seriousmisdemeanor.Aseriousmisdemeanorispunishableby8confinementfornomorethanoneyearandafineofatleast9$430butnotmorethan$2,560.10-6-LSB5420SV(1)91ss/ns6/6
