hb2694/introduced.txtSession of 2026HOUSE BILL No. 2694By Representative Simmons2-41 AN ACT concerning health and healthcare; relating to prescription2 medication; enacting the opioid patients right to know act; requiring3 that a healthcare provider disclose the risks of prescribed opioid use.45 Be it enacted by the Legislature of the State of Kansas:6 Section 1. (a) This act shall be known and may be cited as the opioid7 patients right to know act.8 (b) Before issuing an initial prescription of a schedule II controlled9 substance pursuant to K.S.A. 65-4107, and amendments thereto, or any10 other opioid pain reliever that is a prescription drug in the course of11 treatment for acute or chronic pain, a prescriber shall discuss with the12 patient, or the patient's parent if such patient is a minor, the risks13 associated with the drugs being prescribed.14 (c) The topics that the prescriber shall discuss shall include, but not15 be limited to:16 (1) The risk of addiction and overdose associated with opioid drugs;17 (2) the dangers of taking opioid drugs with alcohol, benzodiazepines18 and other central nervous system depressants;19 (3) the reason that the prescription is necessary;20 (4) alternative treatment that may be available; and21 (5) the risks associated with the use of the drugs prescribed.22 (d) The prescriber shall include a note in the patient's medical record23 that such prescriber has discussed with such patient or such patient's parent24 the risks of developing a physical or psychological dependence on the25 schedule II controlled substance or other opioid to be prescribed and that26 alternative treatment may be available.27 (e) This section shall not apply to a prescription for a patient who is28 currently in treatment for cancer, receiving hospice care from a licensed29 hospice or palliative care or a resident of a long-term healthcare facility or30 to any medications that are being prescribed for use of substance abuse or31 opioid dependence.32 Sec. 2. This act shall take effect and be in force from and after its33 publication in the statute book.
