1 AN ACT concerning health and healthcare; relating to prescription
2   medication; enacting the opioid patients right to know act; requiring
3   that a healthcare provider disclose the risks of prescribed opioid use.

5 Be it enacted by the Legislature of the State of Kansas:
6     Section 1. (a) This act shall be known and may be cited as the opioid
7 patients right to know act.
8     (b) Before issuing an initial prescription of a schedule II controlled
9 substance pursuant to K.S.A. 65-4107, and amendments thereto, or any
10 other opioid pain reliever that is a prescription drug in the course of
11 treatment for acute or chronic pain, a prescriber shall discuss with the
12 patient, or the patient's parent if such patient is a minor, the risks
13 associated with the drugs being prescribed.
14     (c) The topics that the prescriber shall discuss shall include, but not
15 be limited to:
16     (1) The risk of addiction and overdose associated with opioid drugs;
17     (2) the dangers of taking opioid drugs with alcohol, benzodiazepines
18 and other central nervous system depressants;
19     (3) the reason that the prescription is necessary;
20     (4) alternative treatment that may be available; and
21     (5) the risks associated with the use of the drugs prescribed.
22     (d) The prescriber shall include a note in the patient's medical record
23 that such prescriber has discussed with such patient or such patient's parent
24 the risks of developing a physical or psychological dependence on the
25 schedule II controlled substance or other opioid to be prescribed and that
26 alternative treatment may be available.
27     (e) This section shall not apply to a prescription for a patient who is
28 currently in treatment for cancer, receiving hospice care from a licensed
29 hospice or palliative care or a resident of a long-term healthcare facility or
30 to any medications that are being prescribed for use of substance abuse or
31 opioid dependence.
32     Sec. 2. This act shall take effect and be in force from and after its
33 publication in the statute book.
