The State Finance Act is amended by adding5Section 5.1038 as follows:6 (30 ILCS 105/5.1038 new)7 Sec. 5.1038. The Sickle Cell License Fund.8 Section 10. The Illinois Vehicle Code is amended by9changing Section 3-699.14 as follows:10 (625 ILCS 5/3-699.14)11 Sec. 3-699.14. Universal special license plates.12 (a) In addition to any other special license plate, the13Secretary, upon receipt of all applicable fees and14applications made in the form prescribed by the Secretary, may15issue Universal special license plates to residents of16Illinois on behalf of organizations that have been authorized17by the General Assembly to issue decals for Universal special18license plates. Appropriate documentation, as determined by19the Secretary, shall accompany each application. Authorized20organizations shall be designated by amendment to this21Section. When applying for a Universal special license plateHB4934 Enrolled - 2 - LRB104 18743 LNS 32186 b1the applicant shall inform the Secretary of the name of the2authorized organization from which the applicant will obtain a3decal to place on the plate. The Secretary shall make a record4of that organization and that organization shall remain5affiliated with that plate until the plate is surrendered,6revoked, or otherwise canceled. The authorized organization7may charge a fee to offset the cost of producing and8distributing the decal, but that fee shall be retained by the9authorized organization and shall be separate and distinct10from any registration fees charged by the Secretary. No decal,11sticker, or other material may be affixed to a Universal12special license plate other than a decal authorized by the13General Assembly in this Section or a registration renewal14sticker. The special plates issued under this Section shall be15affixed only to passenger vehicles of the first division,16including motorcycles and autocycles, or motor vehicles of the17second division weighing not more than 8,000 pounds. Plates18issued under this Section shall expire according to the19multi-year procedure under Section 3-414.1 of this Code.20 (b) The design, color, and format of the Universal special21license plate shall be wholly within the discretion of the22Secretary. Universal special license plates are not required23to designate "Land of Lincoln", as prescribed in subsection24(b) of Section 3-412 of this Code. The design shall allow for25the application of a decal to the plate. Organizations26authorized by the General Assembly to issue decals forHB4934 Enrolled - 3 - LRB104 18743 LNS 32186 b1Universal special license plates shall comply with rules2adopted by the Secretary governing the requirements for and3approval of Universal special license plate decals. The4Secretary may, in his or her discretion, allow Universal5special license plates to be issued as vanity or personalized6plates in accordance with Section 3-405.1 of this Code. The7Secretary of State must make a version of the special8registration plates authorized under this Section in a form9appropriate for motorcycles and autocycles.10 (c) When authorizing a Universal special license plate,11the General Assembly shall set forth whether an additional fee12is to be charged for the plate and, if a fee is to be charged,13the amount of the fee and how the fee is to be distributed.14When necessary, the authorizing language shall create a15special fund in the State treasury into which fees may be16deposited for an authorized Universal special license plate.17Additional fees may only be charged if the fee is to be paid18over to a State agency or to a charitable entity that is in19compliance with the registration and reporting requirements of20the Charitable Trust Act and the Solicitation for Charity Act.21Any charitable entity receiving fees for the sale of Universal22special license plates shall annually provide the Secretary of23State a letter of compliance issued by the Attorney General24verifying that the entity is in compliance with the Charitable25Trust Act and the Solicitation for Charity Act.26 (d) Upon original issuance and for each registrationHB4934 Enrolled - 4 - LRB104 18743 LNS 32186 b1renewal period, in addition to the appropriate registration2fee, if applicable, the Secretary shall collect any additional3fees, if required, for issuance of Universal special license4plates. The fees shall be collected on behalf of the5organization designated by the applicant when applying for the6plate. All fees collected shall be transferred to the State7agency on whose behalf the fees were collected, or paid into8the special fund designated in the law authorizing the9organization to issue decals for Universal special license10plates. All money in the designated fund shall be distributed11by the Secretary subject to appropriation by the General12Assembly.13 (e) The following organizations may issue decals for14Universal special license plates with the original and renewal15fees and fee distribution as follows:16 (1) The Illinois Department of Natural Resources.17 (A) Original issuance: $25; Amends the Illinois Vehicle Code. Allows a decal to be issued for sickle cell anemia awareness. Provides that a $25 fee for original issuance shall be paid with $10 to the Sickle Cell Anemia License Fund and $15 to the Secretary of State Special License Plate Fund. Provides that a $25 fee for renewal shall be paid with $23 to the Sickle Cell Anemia License Fund and $2 to the Secretary of State Special License Plate Fund. Creates the Sickle Cell Anemia License Fund, from which all money shall be paid as grants to the Sickle Cell Disease Association of Illinois. Makes a conforming change in the State Finance Act.
