A new section of Chapter 30, Article 9 NMSA16 1978 is enacted to read:[bracketed material] = delete17 "[NEW MATERIAL] INDECENT EXPOSURE TO A CHILD OUT OF PUBLICunderscored material = new18 VIEW--PENALTY.--19 A. Indecent exposure to a child out of public view20 consists of a person eighteen years of age or older knowingly21 and intentionally exposing the person's primary genital area to22 a child in a lewd and lascivious manner, when the person and23 child are in a nonpublic place.24 B. Whoever commits indecent exposure to a child out25 of public view is guilty of a fourth degree felony..232820.11 C.
