                                11   RELATING TO TIME; PROVIDING FOR DAYLIGHT SAVING TIME AS THE
                                12   YEAR-ROUND STANDARD OF TIME FOR NEW MEXICO; PROVIDING A
                                13   CONTINGENT EFFECTIVE DATE; MAKING AN APPROPRIATION.

                                15   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
                                16        SECTION 1.    [NEW MATERIAL] EXEMPTION FROM ANNUAL CHANGE OF

                                18  A.   New Mexico is exempt from the advancement of
                                19   time or changeover dates pursuant to Section 260a of the
                                20   federal Uniform Time Act of 1966, as that section may be
                                21   amended or renumbered, and adopts daylight saving time as the
                                22   year-round standard of time for the entire state and all its
                                23   political subdivisions.
                                24  B.   This section shall not be construed to affect
                                25   the standard time established by federal law governing the

                                1    movement of common carriers engaged in interstate commerce or
                                2    the time for performance of an act by an officer or a
                                3    department of the United States, as established by a statute,
                                4    lawful order, rule or regulation of the United States or an
                                5    agency thereof.
                                6  C.   As used in this section, "daylight saving time"
                                7    means the federal standard time established pursuant to Section
                                8    260a of the federal Uniform Time Act of 1966, as that section
                                9    may be amended or renumbered, during the period commencing at 2
                                10   o'clock antemeridian on the second Sunday of March of each year
                                11   and ending at 2 o'clock antemeridian on the first Sunday of
                                12   November of each year.
                                13        SECTION 2.    APPROPRIATION.--One hundred thousand dollars
                                14   ($100,000) is appropriated from the general fund to the
                                15   department of information technology for expenditure in fiscal
                                16   years 2027 and 2028 for conversion of state information

                                17   technology systems to permanent daylight saving time.    Any

                                18   unexpended balance remaining at the end of fiscal year 2028
                                19   shall revert to the general fund.
                                20        SECTION 3.    CONTINGENT EFFECTIVE DATE.--The effective date
                                21   of the provisions of this act is the second Sunday of March or
                                22   the first Sunday of November of a year, whichever occurs first,
                                23   following the effective date of a federal law authorizing a
                                24   state to exempt itself or a part of itself from Section 260a of
                                25   the federal Uniform Time Act of 1966, as certified by the

                                1    secretary of transportation to the New Mexico compilation
                                2    commission and the director of the legislative council service;
                                3    provided that:
                                4  A.   the state of Texas has enacted a law exempting
                                5    Texas or a part of Texas that includes the county of El Paso,
                                6    Texas, from Section 260a of the federal Uniform Time Act of
                                7    1966 and has adopted daylight saving time for the state of
                                8    Texas or a part of the state of Texas that includes El Paso,
                                9    Texas; or
                                10  B.   the county commission of El Paso county, Texas,
                                11   has enacted an ordinance exempting El Paso county from Section
                                12   260a of the federal Uniform Time Act of 1966 and has adopted
                                13   daylight saving time.
