                                                   AN ACT
 To amend chapter 386, RSMo, by adding thereto one new section relating to electric service
           interruption.
 Be it enacted by the General Assembly of the State of Missouri, as follows:
1Section A. Chapter 386, RSMo, is amended by adding thereto
2  one new section, to be known as section 386.1000, to read as
3  follows:
1386.1000.  1.     As used in this section, the following
2  terms mean:
3(1)      "Commission", the Missouri public service
4  commission;
5(2)      "Electrical corporation", the same as defined in
6  section 386.020;
7(3)      "Electric service interruption", an interruption
8  in electric service to a customer if such electric service
9  interruption was not caused by a customer;
10(4)      "Loss", any financial loss a customer incurs as a
11  result of an electric service interruption, including, but
12  not limited to, food, medicine, or any other good;
13(5)      "Rate", the same as defined in section 386.020.
142.     Whenever an electric service interruption occurs
15  that lasts for more than forty-eight hours, and a customer
16  incurs a loss as a result of such electric service

17 interruption, an electrical corporation shall reimburse the
18 customer for the loss from the electric service interruption.
193.    An electrical corporation shall create a form for
20 loss recovery and make the form available on the electrical
21 corporation's website.
224.    If a loss is greater than two hundred dollars, a
23 customer shall submit receipts or any relevant documents for
24 such loss with the form as provided in subsection 3 of this
25 section to the electrical corporation before being
26 reimbursed for the loss by the electrical corporation.
275.    The commission shall require an electrical
28 corporation to maintain a record detailing each instance a
29 transmission of electricity is less than fifty percent of
30 the standard voltage or whenever an electric service
31 interruption affects more than ten customers.     The record
32 shall not include disconnection of service to customers for
33 good cause.     The record shall include:
34(1)    Date, time, and duration of an electric service
35 interruption;
36(2)    Number of customers affected by an electric
37 service interruption;
38(3)    Description of the cause of an electric service
39 interruption, including any equipment involved in the
40 electric service interruption, if applicable;
41(4)    The geographic area of an electric service
42 interruption;
43(5)    Measures taken by an electrical corporation to
44 restore electric service;
45(6)    Measures taken by an electrical corporation to
46 prevent future electric service interruptions; and

47(7)    Amounts paid by an electrical corporation to
48 affected customers for any loss incurred as a result of an
49 electric service interruption.
506.    Copies of any records detailing the information
51 required in subsection 5 of this section shall be made
52 public by an electrical corporation on the electrical
53 corporation's website.
547.    The commission shall promulgate rules to ensure
55 compliance with provisions of this section.       Any rule or
56 portion of a rule, as that term is defined in section
57 536.010, that is created under the authority delegated in
58 this section shall become effective only if it complies with
59 and is subject to all of the provisions of chapter 536 and,
60 if applicable, section 536.028.       This section and chapter
61 536 are nonseverable and if any of the powers vested with
62 the general assembly pursuant to chapter 536 to review, to
63 delay the effective date, or to disapprove and annul a rule
64 are subsequently held unconstitutional, then the grant of
65 rulemaking authority and any rule proposed or adopted after
66 August 28, 2026, shall be invalid and void.
