1A bill to be entitled
2An act relating to the Town of Loxahatchee Groves,
3Palm Beach County; providing an exception to general
4law; prohibiting the sale and use of fireworks within
5the Town of Loxahatchee Groves agricultural
6residential zoning district except under specified
7circumstances; providing applicability; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12Section 1.       Notwithstanding ss. 791.001 and 791.08, Florida
13Statutes, the sale and use of fireworks within the Town of
14Loxahatchee Groves agricultural residential (AR) zoning district
15is prohibited on all days of the year except for the following:
16(1)     Supervised public displays within the jurisdictional
17boundaries of the Town of Loxahatchee Groves where such displays
18are handled by a competent operator to be approved by the Palm
19Beach County Sheriff's Office and Fire Department, and shall be
20of such a character, and so located, discharged, or fired as in
21the opinion of the chief of the fire department, after proper
22inspection, shall not be hazardous to property or endanger any
23person. Application for permits shall be made in writing at
24least 15 days in advance of the date of the display. After such
25privilege shall have been granted, sales, possession, use, and

26    distribution of fireworks for such display shall be lawful for
27    that purpose only. No permit granted hereunder shall be
28    transferable.
29(2)     Nothing herein is intended or shall prevent the
30    importation, purchase, sale, or use of fireworks for
31    agricultural purposes in s. 791.07, Florida Statutes.
32Section 2.       This act shall take effect upon becoming a law.
