Section 287.139, Florida Statutes, is created18and incorporated into part I of chapter 287, Florida Statutes,19to read:20287.139Certain foreign entities domiciled in the People’s21Republic of China; state bidding prohibited.—22(1) For the purposes of this section, the term “covered23foreign entity” means:24(a) An entity that designs, manufactures, assembles, or25procures any goods or services needed for an office environment,26including, but not limited to, the design, manufacturing,27assembly, and procurement of computers, printers, or28interoperable videoconferencing services; and29(b) Whose parent company, controlling interest, or30substantial shareholder is domiciled in the People’s Republic of31China and must comply with the 2015 National Security Law, the322017 National Intelligence Law, or other Chinese law that33requires the parent company, controlling interest, or34substantial stakeholder to cooperate with the Chinese national35defense or national intelligence agencies; or36(c) A Chinese-domiciled company in which the government of37China has an ownership stake; or38(d) An entity or a subsidiary of a parent company included39in the United States Department of Homeland Security’s Uyghur40Forced Labor Prevention Act Entity List; or41(e) A subsidiary of an entity or an entity controlled by42another entity described in this subsection.43(2)On or after July 1, 2026, a covered foreign entity is44ineligible to, and may not, bid on, submit a proposal for, or45enter into or renew a contract, either directly or through a46thirdparty, with an agency for goods, services, or the47procurement of computers, printers, or interoperable48videoconferencing services needed for an office environment.49(3) The prohibition described in subsection (2) applies to50any local agency, local government, or local entity that is a51recipient of state funds that may be used for the procurement,52purchase, or expenditure of funds for any equipment or services53described in subsection (2).54(4) An entity that submits a bid or proposal pursuant to55this section must certify in its bid or proposal that it is not56a covered foreign entity.57(5) If a contracting agency, local government, or local58entity described in subsection (3) determines that an entity has59submitted a false certificationor that an entity is a covered60foreign entity, the contracting agency, local government, or61local entity must immediately terminate the contract with the62entity.63Section 2. This act shall take effect July 1, 2026.
