1A bill to be entitled
2An act relating to prohibited contracting with covered
3foreign entities; creating s. 287.139, F.S.; defining
4the term “covered foreign entity”; providing that a
5covered foreign entity is ineligible to bid or submit
6a proposal for a contract with an agency for certain
7goods or services; providing applicability; requiring
8an entity to certify in its bid or proposal that it is
9not a covered foreign entity; requiring a contracting
10state agency to immediately terminate its contract
11with an entity that submitted a false certification or
12that is determined to be a covered foreign entity;
13providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17Section 1. Section 287.139, Florida Statutes, is created
18and incorporated into part I of chapter 287, Florida Statutes,
19to read:
20287.139Certain foreign entities domiciled in the People’s
21Republic of China; state bidding prohibited.—
22(1) For the purposes of this section, the term “covered
23foreign entity” means:
24(a) An entity that designs, manufactures, assembles, or
25procures any goods or services needed for an office environment,
26including, but not limited to, the design, manufacturing,
27assembly, and procurement of computers, printers, or
28interoperable videoconferencing services; and
29(b) Whose parent company, controlling interest, or
30substantial shareholder is domiciled in the People’s Republic of
31China and must comply with the 2015 National Security Law, the
322017 National Intelligence Law, or other Chinese law that
33requires the parent company, controlling interest, or
34substantial stakeholder to cooperate with the Chinese national
35defense or national intelligence agencies; or
36(c) A Chinese-domiciled company in which the government of
37China has an ownership stake; or
38(d) An entity or a subsidiary of a parent company included
39in the United States Department of Homeland Security’s Uyghur
40Forced Labor Prevention Act Entity List; or
41(e) A subsidiary of an entity or an entity controlled by
42another entity described in this subsection.
43(2)On or after July 1, 2026, a covered foreign entity is
44ineligible to, and may not, bid on, submit a proposal for, or
45enter into or renew a contract, either directly or through a
46thirdparty, with an agency for goods, services, or the
47procurement of computers, printers, or interoperable
48videoconferencing services needed for an office environment.
49(3) The prohibition described in subsection (2) applies to
50any local agency, local government, or local entity that is a
51recipient of state funds that may be used for the procurement,
52purchase, or expenditure of funds for any equipment or services
53described in subsection (2).
54(4) An entity that submits a bid or proposal pursuant to
55this section must certify in its bid or proposal that it is not
56a covered foreign entity.
57(5) If a contracting agency, local government, or local
58entity described in subsection (3) determines that an entity has
59submitted a false certificationor that an entity is a covered
60foreign entity, the contracting agency, local government, or
61local entity must immediately terminate the contract with the
62entity.
63Section 2. This act shall take effect July 1, 2026.
