Kevin SchmidtSYNOPSIS AS INTRODUCED:225 ILCS 85/15.2 newAmends the Pharmacy Practice Act. Defines "retail pharmacy". Provides that a retail pharmacy that, on average, receives 150 or more prescription drug orders during its operating hours must satisfy one of the following requirements during all times that the pharmacy remains open for the transaction of business: (1) a pharmacist is present at the location and working in his or her capacity as a pharmacist, or (2) a registered pharmacy technician, registered certified pharmacy technician, student pharmacist, or other supportive staff that is authorized to sell prescriptions is present at the location and working in that capacity pursuant to provisions concerning pharmacy working conditions.LRB104 15945 AAS 29180 bA BILL FORHB4243 LRB104 15945 AAS 29180 b1 AN ACT concerning regulation.2 Be it enacted by the People of the State of Illinois,3 represented in the General Assembly:4 Section 5. The Pharmacy Practice Act is amended by adding5 Section 15.2 as follows:6 (225 ILCS 85/15.2 new)7 Sec. 15.2. Retail pharmacy; pharmacist on site.8 (a) As used in this Section, "retail pharmacy" means a9 store, shop, or other place where drugs, medicines, or poisons10 are dispensed, sold, or offered for sale at retail.11 (b) A retail pharmacy that, on average, receives 150 or12 more prescription drug orders during its operating hours must13 satisfy one of the following requirements during all times14 that the pharmacy remains open for the transaction of15 business:16 (1) a pharmacist is present at the location and17 working in his or her capacity as a pharmacist; or18 (2) a registered pharmacy technician, registered19 certified pharmacy technician, student pharmacist, or20 other supportive staff that is authorized to sell21 prescriptions is present at the location and working in22 that capacity pursuant to subsection (c-5) of Section23 15.1.
Amends the Pharmacy Practice Act. Defines "retail pharmacy".
