1A bill to be entitled
2An act relating to reporting lost or stolen firearms;
3creating s. 790.402, F.S.; requiring individuals to
4report lost or stolen firearms to the local law
5enforcement agency in the jurisdiction in which the
6loss or theft occurred within a specified timeframe;
7requiring such individuals to provide specified
8information to the local law enforcement agency;
9requiring the local law enforcement agency to create
10an incident report upon receiving a report of a lost
11or stolen firearm; requiring an individual who
12reported a firearm lost or stolen to notify the local
13law enforcement agency to which the loss or theft was
14reported within a specified timeframe if the firearm
15is subsequently recovered; providing an effective
16date.

18Be It Enacted by the Legislature of the State of Florida:

20Section 1. Section 790.402, Florida Statutes, is created to
21read:
22790.402 Reporting of lost or stolen firearms.—
23(1)An individual who owns or lawfully possesses a firearm
24must report the loss or theft of the firearm to the local law
25enforcement agency in the jurisdiction in which the loss or
26theft occurred within 48 hours after the time that he or she
27knew or reasonably should have known that the firearm had been
28lost or stolen and provide to the local law enforcement agency
29the make, model, caliber, and serial number, if known, of the
30firearm and the date, time, place, and circumstances surrounding
31the last time the individual saw the firearm.
32(2)Notwithstanding any other law, upon receiving a report
33of a lost or stolen firearm, the local law enforcement agency
34shall create an incident report and, upon request of the
35reporting individual, provide a copy of the report to the
36individual at no cost.
37(3)An individual who has reported a firearm lost or stolen
38under subsection (1) and who subsequently recovers the firearm
39shall notify the local law enforcement agency to which the loss
40or theft was reported within 48 hours after the recovery.
41Section 2. This act shall take effect July 1, 2026.
