WILLIAMS, MADDEN, GILLEN AND WAXMAN,NOVEMBER 10, 2025REFERRED TO COMMITTEE ON HOUSING AND COMMUNITY DEVELOPMENT,NOVEMBER 12, 2025AN ACT1 Amending the act of April 6, 1951 (P.L.69, No.20), entitled "An2 act relating to the rights, obligations and liabilities of3 landlord and tenant and of parties dealing with them and4 amending, revising, changing and consolidating the law5 relating thereto," in recovery of possession, further6 providing for hearing, judgment, writ of possession and7 payment of rent by tenant.8 The General Assembly of the Commonwealth of Pennsylvania9 hereby enacts as follows:10 Section 1. Section 503 of the act of April 6, 1951 (P.L.69,11 No.20), known as The Landlord and Tenant Act of 1951, is amended12 by adding a subsection to read:13 Section 503. Hearing; Judgment; Writ of Possession; Payment14 of Rent by Tenant.--* * *15 (b.1) (1) The justice of the peace shall stay the execution16 of a writ of possession of the real property, from day to day,17 in the event of extreme weather conditions affecting the real18 property, including:19 (i) a temperature or next-day forecasted temperature of1 thirty-two degrees Fahrenheit or lower;2 (ii) a winter storm warning or blizzard warning issued by3 the National Weather Service;4 (iii) a hurricane warning or tropical storm warning issued5 by the National Weather Service; and6 (iv) an excessive heat warning issued by the National7 Weather Service.8 (2) When a stay has been granted under this subsection, the9 execution of the writ of possession for which the stay has been10 granted shall be given priority and completed within five days11 after the extreme weather conditions cease.12 (3) This subsection shall apply to a tenant enrolled in any13 of the following programs at the time of the service of the writ14 of possession:15 (i) Low-Income Home Energy Assistance Program.16 (ii) Medicaid.17 (iii) Medicare.18 (iv) Social Security Disability Insurance.19 (v) Special Supplemental Nutrition Program for Women,20 Infants and Children.21 (vi) Supplemental Nutrition Assistance Program.22 (vii) Supplemental Security Income.23 * * *24 Section 2.
