MILLER, BOROWSKI, MERSKI, TAKAC, RIVERA, SCOTT,INGLIS AND BOYD, OCTOBER 31, 2025REFERRED TO COMMITTEE ON HUMAN SERVICES, NOVEMBER 6, 2025AN ACT1 Amending the act of April 9, 1929 (P.L.343, No.176), entitled2 "An act relating to the finances of the State government;3 providing for cancer control, prevention and research, for4 ambulatory surgical center data collection, for the Joint5 Underwriting Association, for entertainment business6 financial management firms, for private dam financial7 assurance and for reinstatement of item vetoes; providing for8 the settlement, assessment, collection, and lien of taxes,9 bonus, and all other accounts due the Commonwealth, the10 collection and recovery of fees and other money or property11 due or belonging to the Commonwealth, or any agency thereof,12 including escheated property and the proceeds of its sale,13 the custody and disbursement or other disposition of funds14 and securities belonging to or in the possession of the15 Commonwealth, and the settlement of claims against the16 Commonwealth, the resettlement of accounts and appeals to the17 courts, refunds of moneys erroneously paid to the18 Commonwealth, auditing the accounts of the Commonwealth and19 all agencies thereof, of all public officers collecting20 moneys payable to the Commonwealth, or any agency thereof,21 and all receipts of appropriations from the Commonwealth,22 authorizing the Commonwealth to issue tax anticipation notes23 to defray current expenses, implementing the provisions of24 section 7(a) of Article VIII of the Constitution of25 Pennsylvania authorizing and restricting the incurring of26 certain debt and imposing penalties; affecting every27 department, board, commission, and officer of the State28 government, every political subdivision of the State, and29 certain officers of such subdivisions, every person,30 association, and corporation required to pay, assess, or1 collect taxes, or to make returns or reports under the laws2 imposing taxes for State purposes, or to pay license fees or3 other moneys to the Commonwealth, or any agency thereof,4 every State depository and every debtor or creditor of the5 Commonwealth," in special funds, further providing for6 disposition of Budget Stabilization Reserve Fund.7 The General Assembly of the Commonwealth of Pennsylvania8 hereby enacts as follows:9 Section 1. Section 1703-A(b) of the act of April 9, 192910 (P.L.343, No.176), known as The Fiscal Code, is amended and the11 section is amended by adding a subsection to read:12 Section 1703-A. Disposition of Budget Stabilization Reserve13Fund.14 * * *15 (b) Appropriation.--Except as provided under [subsection16 (c)] subsections (c) and (d), whenever the Governor determines17 that an appropriation from the Budget Stabilization Reserve Fund18 is necessary to meet emergencies involving the health, safety or19 welfare of the residents of this Commonwealth or to20 counterbalance downturns of the economy which result in21 significant unanticipated revenue shortfalls, the Governor shall22 present a request for an appropriation which may include the23 specifics of the proposal and suggested ancillary and24 substantive legislation as may be necessary to the chairman of25 Appropriations Committee of the Senate and the chairman of the26 Appropriations Committee of the House of Representatives. The27 General Assembly may then through approval of a separate28 appropriation bill by a vote of two-thirds of the members29 elected to the Senate and the House of Representatives30 appropriate money from the Budget Stabilization Reserve Fund to31 meet the needs identified in the Governor's proposal. Any money32 appropriated according to this section which has then lapsed33 shall be returned to the Budget Stabilization Reserve Fund.20250HB2007PN2561 - 2 -1 * * *2 (d) SNAP benefits emergency transfer.--Notwithstanding any3 other provision of this section, no later than November 1, 2025,4 $62,000,000 shall be transferred from the Budget Stabilization5 Reserve Fund as follows:6(1) The sum of $50,000,000 shall be transferred to the7 Department of Agriculture for purposes of providing grants to8 food banks located in this Commonwealth to fund staff and9 operations and to purchase food and other necessities to10 ensure that each food bank has the resources necessary to11 respond to the needs of Pennsylvania families due to the loss12 of Federal SNAP benefits beginning on November 1, 2025. The13 Department of Agriculture shall administer funds received14 under this paragraph under the act of December 11, 199215 (P.L.807, No.129), known as the State Food Purchase Program16 Act, and the act of November 23, 2010 (P.L.1134, No.113),17 known as the Pennsylvania Agricultural Surplus System Act.18(2) The sum of $10,000,000 shall be transferred to the19 Department of Human Services for grants to organizations that20 assist senior citizens in addressing hunger, food insecurity21 and isolation through wellness checks and delivery of22 nutritional meals.23(3) The sum of $2,000,000 is transferred to the24 Department of Agriculture and the Department of Human25 Services for the administration of this subsection and for26 the advertisement of the availability of grants and the27 additional assistance available under this subsection.28 Section 2.
