To establish penalties for violating section 104(f) of the Foreign Assistance Act of 1961.
1.
Short title
This Act may be cited as the   Aid Accountability Act of 2025  .
2.
Penalties for violating section 104(f) of the Foreign Assistance Act of 1961
Section 104(f) of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2151b(f) ) is amended by adding at the end the following:
(4)
(A)
A Federal employee who knowingly violates any requirement under this subsection—
(i)
shall be terminated from Federal employment;
(ii)
may not be employed by the Federal Government after such violation; and
(iii)
shall be fiscally liable for, and shall pay to the Federal Government, an amount equal to the amount of funds illegally allocated to the activity that was in violation of such requirement in order to provide restitution for such violation.
(B)
A grantee, subgrantee, contractor or other recipient of Federal funds who violates any of the requirements under this subsection may not receive any Federal funds after such violation.
(C)
The Secretary of State—
(i)
shall make a final determination with respect to any violation of a requirement under this subsection and the penalties to be imposed pursuant to subparagraph (A) or (B), and such final determination shall not be subject to review or reversal except by a Federal court of competent jurisdiction; and
(ii)
not later than 60 days after making a determination pursuant to clause (i), shall submit a report to Congress that includes—
(I)
a description of the nature of the violation;
(II)
who carried out or was involved in the violation; and
(III)
what will be done to ensure such violation is not repeated.
(D)
Each final determination by the Secretary of State pursuant to subparagraph (C)(i) shall be subject to the procedures set forth in  chapter 8  of title 5, United States Code (commonly referred to as the  Congressional Review Act ).
